Legal Assistant/Paralegal Duties: Obtain all documentation of the debt including: Contracts, invoices, personal guarantees, promissory notes and security agreements. Confirm information contained in the documentation, such as claim amount, term of delinquency, subject of claim and signatories. Public records research for information about a debtor’s financial status, including real estate records and prior judgments. Drafting of a demand letter to the debtor, which must meet all applicable state and federal fair debt collection practices acts. Litigation Activity Duties. Hiring and negotiating payment arrangements with local attorneys. Communicating regularly with attorneys in order to: Update case status. Provide attorneys with required information/documentation. Corresponding with management regarding the status of collection efforts and maintaining a database with payments and collections and court costs. Draft or prepare a variety of documents, including the complaint and supporting exhibits, summons and related documents, motions for judgment or default judgment and notice of intent to file lien statement. Completing the filing and service of the complaint, monitoring date for response to the complaint, scheduling depositions and creditor’s examinations and calculating attorney’s fees and costs. Drafting or preparation of a variety of legal documents, which may be delegated to a paralegal. They include wage or bank garnishment forms, writs of execution, bills of costs, notices of lien on real property, promissory notes, releases of judgment or lien, proofs of claim for matters resulting in bankruptcy and affidavits for transfer of foreign judgment. Obtaining an exemplified copy of foreign judgments, arranging for an indemnity bond from the sheriff, preparing the bid for and attend sheriff’s sale of real property, maintaining communication with the sheriff about a levy on personal property,. Calculating post-judgment interest and conducting asset searches, skip tracing or job verification inquiries.
Qualification and Experience
QUALIFICATIONS: Paralegal experience is highly preferred. Collections experience is preferred. Must be goal oriented and self-motivated. Experience using computers and maintain records. Knowledge of consumer and collection law is preferred. Must have excellent written and verbal communication skills.
