Law Clerk II The Clerk will provide support to the government prosecutors during all phases of criminal and civil investigation, litigation, and appeals. Performs complex legal research and writing. Examines, prepares and processes a variety of technical legal documents. Reviews incoming material and determines the need for assembly and preparation of a variety of legal documents, e.g., complaints, responses, motions, orders, answers, pleadings, and subpoenas. Reviews court records, including trial and sentencing transcripts, to evaluate defendants’ entitlement to relief. Conducts legal research into sentencing law and related criminal issues. Drafts responses to motions and other court filings. Evaluates appellate briefs and drafts response briefs. States advantageous positions, demonstrating creativity, skill and resourcefulness as necessary, e.g., develop legal authority from sources that are not obvious. Acts independently and/or as a team leader on larger projects. Responsibilities may include acting as primary interface with appellate AUSAs and other staff. Monitors the progress of pending cases and initiates action to insure that legal pleadings, forms, reports, correspondence, and other documents are prepared and submitted within established deadlines. Keeps appropriate staff members informed about the current status of cases.
Qualification and Experience
Qualifications: Bachelor’s Degree (in a technical field or business administration) or equivalent, and five to seven years of related (project support or management) experience. Must have a Law Degree; for some tasks comparable combination of education and experience may be acceptable. Must have 2-3 years of progressively more responsible experience on litigation support projects including proven capabilities and communication skills to successfully interact with clients and attorneys. Requires sound working knowledge of federal and state court systems, legal research procedures, and legal research resources. Requires excellent written and oral communication skills and thorough knowledge of legal research tools such as: LEXIS and Westlaw. Must have hands on familiarity with a variety of computer applications, including word processing, databases, spreadsheets and imaging. Role also requires hands on familiarly with ESI tools and knowledge of e-discovery procedures and resources.
