Superior Court Intern, Fall 2017 The interns work directly with attorneys, investigators, and social service advocates on the following: client interviews (keep confidential all information involving client representation, and the work they perform on behalf of clients); arraignment and bail arguments; legal research; meeting with and preparing with clients in the office and at various prisons, jails and hospitals; drafting pretrial motions, affidavits and legal memoranda; pretrial investigation, including visiting the locations of alleged crimes and interviewing witnesses; and jury and bench trials in criminal cases. Students qualified to appear in court under SJC Rule 3:03 represent clients at arraignment, bail hearings, bail appeals, and occasionally at less complex motions, all under the supervision of an experienced attorney. Students are invited to attend court as much as they would like, and 3:03 certified students who work in unit full time are in court to conduct arraignment/bail hearings at least weekly. Out-of-court time focuses on legal research and writing, investigation, interviewing witnesses, and assisting attorneys in preparing for trials. Students are asked to get as involved in cases as possible, and when appropriate will be asked to second-seat at motions and trials. Should be a law student who has completed or be enrolled in an evidence or trial practice class, with the written approval by their Dean, may represent clients under the supervision of a staff public defender in court per SJC Rule 3:03. Must have taken a legal writing class or a class that involves legal research and writing. Should preferably have taken classes in evidence, criminal law, criminal procedure, constitutional law, critical legal theory, and/or trial advocacy. Experience working with low income clients, people of color, immigrants, LGBT people, people with disabilities or mental health conditions or people in other underrepresented groups is desired. Ability to speak a foreign language is a plus.
