Attorney Advisor The candidate will provide intellectual property law support to the department, with an emphasis on cybersecurity matters. Responsible for providing legal and policy advice and guidance to department on matters relating to licensing, terms of service, data rights, particularly as set forth in the Federal Acquisition Regulation (FAR)-based clauses, copyright and trademark matters, and to a more limited extent, patent matters. Provide advice on the full range of intellectual property law, including copyrights, trademark, data rights, licensing, and to a more limited extent, patents. Work closely with program officials, attorneys, and technical personnel developing, utilizing and deploying complex technologies in interpreting the scope of applicable licenses (including open source), terms of service, and government contracts to ensure that such agreements contain appropriate terms and account for related intellectual property issues. In particular, support the development and use of complex cybersecurity technologies by ensuring intellectual property law issues are identified and addressed. Work closely with program officials drafting and publishing documents to ensure that department's use of written materials, both internally and externally, accords with copyright law and other intellectual property rights. Advise department Public Affairs personnel regarding intellectual property-related aspects of media and public speaking engagements, to include releases, content license agreements, and scope of fair use defenses. Advise on the development and negotiation of information sharing and technological collaboration agreements, to ensure that intellectual property issues are appropriately addressed and risks mitigated. Provide litigation support on intellectual property cases.

Qualification and Experience

The candidate of GS-14: Must have 3 years of Specialized Experience as a practicing attorney (equivalent in nature to the next lower level in the Federal service for the grade level applied for), where such experience equipped the applicant with the particular knowledge, skills, and abilities needed to successfully perform the duties of this position. GS-14 or GS-15: The first professional law degree (LL.B. or JD degree) or the second professional law degree (LL.M.) and specialized professional legal experience in excess of 3 years that is commensurate with the duties and responsibilities. Able to analyze complex legal and factual issues, perform underlying legal research, provide counsel to senior officials and must have excellent writing skills.
