Profile

Senior Claims Counsel Duties: Manages multi-state claim litigation arising from liability, cargo and property damage insurance policies. Track and manage litigation in all suits relating to liability, cargo and property damage policies and bad faith cases. Maintain and update master litigation log. Update and advise Corporate Counsel regarding progress in all ongoing cases. Attend mediation/trials. Strategic planning and guidance regarding ongoing and future litigation. Consult with and advise adjusters regarding pre-litigation matters in effort to prevent litigation. Hire and fire local counsel; work with local counsel throughout litigation of cases; review and approve invoices for local counsel and retained experts. Review/draft/revise legal documents and correspondence. Advise and consult with Underwriters regarding case strategy, settlement authority, and local counsel performance. Assist in supervising in-house investigator and in assigning in-house investigator to surveillance opportunities. Advise CTCM regarding various legal issues. Review/revise/advise policy language wording. Review/revise/approve all denials and consult with adjusters and claims manager regarding same. Advise and consult with Corporate Counsel and company personnel regarding a variety of legal issues.

Qualification and Experience

Qualifications: J.D. Degree and 5+ years of insurance experience, either in litigation or as in-house counsel for an insurance company or third party claims administrator. JD Degree and Missouri Bar Membership. Must be proficient in typing, reading comprehension, and business and legal writing skills. Must have excellent communications, grammar, vocabulary, spelling, proofing and editing skills. Must have a good understanding of statutes, regulations and case law. Working knowledge of Windows 98 or higher, Microsoft Office, Microsoft Word or Word Perfect, Microsoft Excel, Microsoft Outlook, AS400, Kronos Timekeeper, Content Manager, Scanning software, Westlaw or LexisNexis; or equivalent software. Ability to read and interpret legal documents. Ability to write routine and complex reports, memorandums and correspondence. Ability to speak effectively before groups of customers or employees of organization. Excellent telephone communication skills. Ability to add, subtract, multiply and divide in all units of measurement, using whole numbers, common fractions, and decimals. Ability to compute rate, ratio, and percent and to draw and interpret bar graphs. Ability to apply common sense understanding to carry out instructions furnished in written, oral or diagram form. Ability to evaluate claims files and propose litigation plans. Ability to advise Corporate Counsel and Claims Manager on course of action in litigated matters that is consistent with corporate goals and membership’s best interests. Ability to implement cost controls and analyze all litigated matters for compliance with same.
