Assistant General Counsel I Healthcare Duties: Under the general direction of an Associate General Counsel, responsible for essentially all aspects of legal representation for one or more regions within Fresenius Kidney Care. Specifically, the Assistant General Counsel I, under general guidance from manager or Assistant General Counsel II, reviews and prepares contracts and other legal documents, conducts research, provides legal opinions and advice to other Law Department attorneys and company personnel within Fresenius Kidney Care, and assists corporate litigators in potential litigation matters. Provides legal advice and support concerning all aspects of healthcare law with particular emphasis on regulatory compliance, contract review, advice, negotiations and transactions. Within assigned region, provides advice, conducts research and/or investigates, as applicable, in all areas of health care law, including: Fraud and Abuse, Stark and general health care related legal issues. Health planning and licensure. Medicare certification and de-certification. Billing & Reimbursement. Joint Ventures. Antitrust and Non-compete issues. HIPAA, Medical Records, Confidentiality. Personnel issues. Medical Staff issues including credentialing/privileges, advanced practitioners, disciplinary actions. Governing Body issues and Medical Director issues. Patient issues. Participates in the resolution of a wide range of business, contractual, financial and operational issues relating to healthcare operations and healthcare reimbursement. Drafts, reviews, revises, negotiates and manages legal agreements and documents. Confers with Senior Counsel on more complex documents or cases. Works towards innovative solutions to meet business objectives while ensuring regulatory compliance and mitigating business and legal risk. Collaborates with corporate departments including compliance, clinical, medical, risk management and human resources to resolve multi-faceted issues. Assists litigation counsel with potential and pre-litigation matters. Provides advice to and conducts research for senior attorneys as requested. Assist with various projects as assigned by a direct supervisor.
Qualification and Experience
Qualifications: JD Degree from an accredited college or university required. Massachusetts License to practice law required.5 – 8 years’ experience as a practicing attorney with responsibility in Corporate, Transactional and/or Healthcare Law. Ability to work independently and manage numerous complex legal issues simultaneously with minimum supervision. Strong commitment to customer service in client relations. Ability to apply sound business judgment within a legal context. Excellent legal research skills. Strong oral and written communication skills. Ability to communicate effectively with management , corporate and support staff, field personnel, attorneys, witnesses and experts. Demonstrated presentation skills. Proficient with PCs, Microsoft Office applications and case management databases.
