Assistant Attorney General - Health and Human Services Duties : Represent state agencies involved in insurance regulation, health insurance, and managed health care. Offers a diverse and stimulating general counsel practice. The Health and Human Services Section provides advice and litigation services to client agencies administering the state's public assistance and health programs, including the following (items in bold are expected to be a particular focus of this position): Department of Business and Consumer Services insurance regulatory programs, including the Division of Financial Regulation and the Oregon Health Insurance Marketplace; Health insurance program of the Public Employees Retirement System; Oregon Health Authority, with responsibilities for medical assistance (including Coordinated Care Organizations), Oregon Prescription Drug Program, Oregon Educators Benefits Board, Public Employees' Benefits Board, addictions and mental health, public health, licensing, health analytics, and Oregon State Hospital; Department of Human Services programs for adults and people with disabilities, licensing and adult abuse oversight; Department of Education's Office of Child Care; and Psychiatric Security Review Board. Provide a wide array of legal services. These include providing written and oral legal advice on clients' authority and other statutory issues, assisting agencies with drafting administrative rules and orders, advising client agencies on public records and meetings issues, drafting and reviewing procurements and contracts, and representing agencies in administrative proceedings, in negotiations and, occasionally, in court. The Section has been actively involved in advising affected agencies on implementing state and federal health system reform and is a resource for the Division on health law.
Qualification and Experience
Qualification: Must be an active member of the Oregon State Bar by time of hire. Should have deep and broad knowledge of health law, particularly in the following areas (listed in priority order): Health insurance and managed care transactions, contracts, and advice; Medicaid law, mental health law, HIPAA privacy, and contested case hearings; and Public assistance programs, and the other issues handled by the Section.
