Associate Counsel Duties: Reports on status of all lawsuits regarding Hospital including matters filed against the hospital by current or former patients, residents, employees, and BCIA or other entity. Monitors the progress of the attorney(s) assigned as outside counsel including matters covered by liability insurance company, ensuring that the Hospital’s interest is protected; that the minimal amount possible is paid for settlement of any cases, and that counsel fees are minimized to the extent possible. Supports hospital staff by performing research and providing legal guidance so as to minimize liability and ensure compliance with all applicable laws. Oversees the filing of Certificate of Need applications for the initiation of expansion of health care services at the Hospital and to manage any appeals filed pursuant thereto at the direction of the Executive Vice President and General Counsel. Files waiver applications with the State Department of Health and Senior Services as requested at the direction of the Executive Vice President and General Counsel. Participates and assists in the implementation of the Corporate Compliance Program. Participates and assists the Human Resources department with employment and labor matters, including labor negotiations, arbitrations, grievances, and general advice. Reviews and negotiates all Hospital contracts and agreements including vendor agreements, employment and professional services or consultation contracts. Drafts contracts, agreements, and legal correspondence and ensures compliance with same as well as all applicable laws under the direction of the Executive Vice President and General Counsel. Participates in professional development conferences, workshops, and other professional activities to maintain licensure and/or remain professionally current with advances in field of expertise. Coordinates all insurance matters including applications and ongoing claims management. Assists the Finance Department with various matters (research and advice on reimbursement matters, appeals, billing, materials management, etc…) . Assists the Executive Vice President and General Counsel in managing the department’s budget throughout the year, including review of outside counsel. Participates in developing Medical Center policies and procedures, reviewing policies and procedures as developed to ensure they are in compliance with requirements of regulatory agencies; recommends changes as required by changes in regulatory agency policies and requirements. Provides legal services in matters connected with properties owned or controlled by the Medical Center. Represents the Medical Center in court and governmental agency hearings (e.g., small claims court, guardianship and commitment hearings); participates in malpractice claims review and associated legal proceedings. Drafts requested documents or policies, (e.g., Medical Staff By-Laws, Board Resolutions) as requested at the direction of the Executive Vice President and General Counsel. Serves as member of the Medical Center Ethics Committee to provide legal consultation and participates in attaining individual decisions and overall policy direction. Reviews and negotiates Medical Center contracts, as requested Develops physician agreements. In conjunction with outside counsel, reviews contract compliance issues with Bergen County Improvement Authority. Prepares responses to, meets and negotiates with regulatory agencies, as requested. Responsible for initiating and follow-up legal action with regard to Medical Center collection issues.

Qualification and Experience

Requirements: Law Degree required. Admitted to the bar in New Jersey. 3+ years of general practice with preferred emphasis on health law and matters relating to Medical Center operations.
