Associate General Counsel -Healthcare Regulatory Affairs The candidate will lead Healthcare Regulatory Affairs and Privacy Program. Will manage legal and other professional staff. Oversee functional area initiatives, activities, and special projects. Serve as a healthcare regulatory and privacy resource for regional and community employees. Prepare regulatory reports for senior management. Advise and counsel operations on a myriad of healthcare regulatory issues, including fraud and abuse, anti-kickback, stark/self-referral, and privacy and security. Oversee and manage government audits, investigations, self-disclosures and settlement agreements. Counsel operations on healthcare regulatory risks and assist in developing strategic solutions. Work with Chief Compliance Officer and operations to develop and revise compliance policies and procedures involving healthcare regulatory matters. Work with Chief Compliance Officer and Human Resources to develop and revise compliance training involving healthcare regulatory matters. Advise, draft and manage healthcare related contracts, including provider agreements, lease agreements, etc. Maintain and manage HIPAA and privacy program, including policies and procedures. Collaborate with Human Resources and Chief Compliance Officer to disseminate HIPAA and privacy program communications and training. Work with operations, IT and Chief Compliance Officer to execute HIPAA and privacy monitoring and auditing compliance program. Oversee tracking and reporting of potential breaches to state and federal agencies. Establish corrective action plans and monitor implementation of those plans. Oversee HIPAA hotline, tracking, responding and following up to inquiries and allegations. Negotiate and manage business associate agreements.
Qualification and Experience
The candidate should have JD degree. Must have 6-10 years healthcare regulatory and HIPAA/privacy experience. Demonstrated management and leadership experience required. In-house legal experience in a healthcare organization a plus. Member in good standing of the Massachusetts Bar required. Knowledge and experience with federal and state healthcare regulatory and privacy laws and regulations required. Strong oral and written communication and presentation skills a must.
