Attorney III (Enforcement Attorney) Duties: Work under direction & requires thorough knowledge of substantive & procedural law in order to serve as a lead attorney by providing legal advice & consultation to agency personnel; provides work direction to secretaries, paralegals, other attorneys & investigators for assigned cases (e.g.., licensure, criminal acts, drug & alcohol impairment, mental impairment, physical impairment, sexual misconduct, minimal standards of care & inappropriate prescribing); reviews & approves enforcement subpoenas; researches variety of legal issues including most complex legal concerns & assists in resolution, negotiation, settlement &/or litigation of legal matters; commits to satisfying internal & external customers by responding to requests in a timely manner, proactively identifying customer needs & working to resolve customer complaints. Prepare cases for citation; contacts, interviews & deposes witnesses; contacts & interviews expert medical witnesses; prepares difficult & complex allegations wherein disciplinary action is contemplated against applicants & licensees of the Board. Review cases, makes decisions as to readiness for formal disciplinary proceedings; makes recommendations to Medical Board's Secretary & Supervising Member as to whether formal action is supportable &/or to pursue other resolution (e.g.., Quality Intervention Panel (QIP), letter of caution, close); recommends appropriateness of office conferences, issuance of subpoenas or referral to other agencies, police departments, prosecutor or enforcement bodies. Meet & coordinate matters with appropriate federal, state & local enforcement agencies (e.g.. Drug Enforcement Administration, Pharmacy Board, local prosecutors); holds conferences that may involve opposing attorneys as well as investigators, police & other law enforcement officials, & may result in recommendations as to how to, or whether to, proceed in particular cases. Assist in answering correspondence & providing information to government officials, licensees & the general public concerning policies, actions & positions of the Medical Board involving complex medical/legal issues. Perform miscellaneous enforcement duties, as assigned, to facilitate operation efficiency such as processing documents produced by Medical Board staff during peak work periods, assists Executive Director or his/her designee in absence of other enforcement personnel.
Qualification and Experience
Qualification: Admission to Ohio Bar pursuant to Section 4705.01 of Revised Code; 6 mos. exp. as licensed attorney OR equivalent of Minimum Class Qualifications For Employment may be substituted for the experience required, but not for the mandated licensure. Knowledge of law (i.e., procedural & substantive); legal research methods; legal writing; interviewing; laws, rules & procedures applicable to operations of employing agency; employee training & development required. Ability to deal with large number of variables & determine specific course of action; organize & interpret extensive variety of legal material in books, journals or legal documents; communicate verbally regarding legal issues; handle sensitive contacts with government officials, adverse parties &/or general public required.
