Staff Attorney Duties: Performs advanced (senior-level) attorney work. Work involves directing and planning legal activities, including complex legal research and analysis, overseeing the preparation of legal documents, interpreting laws and regulations, and rendering legal advice and counsel; provide legal advice and guidance to DARS programs as well as other HHS System programs. May plan, assign, and/or supervise the work of others. Works under limited supervision with considerable latitude for the use of initiative and independent judgment. Provide legal support to DARS programs including Division for Early Childhood Intervention (ECI), Comprehensive Rehabilitation Services, Independent Living Services, and Autism, as well as other HHS System programs; Investigate and prepare responses to internal and external complaints including Dept. of Education, Dept. of Labor, discrimination, etc.; Provide legal advice and guidance to executive management related to administrative matters and selected HHS System programs; Provide review, consultation and representation of agency in administrative matters including, protests and appeals, drafting and review for legal sufficiency; Draft, coordinate, and review policies and procedures; Advise staff on legal matters and the interpretation and application of laws and regulations including but not limited to agency program laws; Preparation of written legal opinions, briefs, proposals, and reports; Participate in the rulemaking function, including drafting and reviewing rules; Review, draft, and/or analyze state and federal laws, rules, and regulations. Assist in planning, advising, and overseeing complex legal analysis and risk assessment; May plan, assign, and/or monitor the work of others; Travel to field offices as needed Performs related work as assigned.
Qualification and Experience
Requirements: Graduation from an accredited four-year college or university. Must hold a JD Degree from an accredited law school. Licensed to practice law in the State of Texas. Licensed to practice law 5+ years. Experience practicing law for at least three years. Knowledge of legal principles, practices, and proceedings. Skill in organizing and expressing complex legal problems clearly and concisely both orally and in writing. Skill in identifying problems, evaluating alternatives, and implementing solutions. Skill in demonstrating sound judgment in the performance of job duties. Skill in working collaboratively and cooperatively with clients, other government officers and employees, and stakeholder groups. Ability to analyze advanced factual and legal issues related to a wide variety of federal and state laws. Ability to organize and manage in a timely fashion multiple tasks of varying priorities and to make efficient use of time and resources. Ability to think creatively and apply clear, logical problem-solving techniques. Ability to communicate effectively, orally and in writing, with a wide range of audiences. Ability to maintain effective and collegial relations with all levels of management and staff. Ability to use computer applications and databases related to essential functions of the job, including computer-assisted legal research, word processing software, and the Internet.
