Associate Attorney The candidate will oversee the legal process for all accounts referred to the Legal Department in assigned jurisdictions. Will review accounts referred to the Legal Department to determine whether legal action is appropriate and to otherwise identify potential legal, compliance, or internal policy-related issues with respect to such accounts. Review, revise, approve and execute all appropriate legal pleadings and documents with respect to a particular account, including attorney letters, complaints, summonses, answers, motions, proposed orders, disclosures and discovery, garnishments, satisfactions and revivals. Review and respond to answers, disputes, motions and other correspondence from consumers and opposing attorneys related to actual or potential litigation. Appear for return dates. Prepare for and conduct trials, mediations, pre-trial conferences and hearings as appropriate, which may include organizing and reviewing exhibits, preparing witnesses, conducting relevant legal research, and developing arguments and direct and cross examinations in support of all claims and in defense of any counterclaims. Communicate with opposing counsel, consumers, and clients and/or client services to facilitate settlement of accounts where appropriate. Identify and resolve any potential compliance issues in conjunction with the Director of Compliance and General Counsel. Support other attorneys and cover appearances as necessary. Assist in developing, reviewing, updating and implementing Legal Department policies and procedures. Assist Legal Department Supervisor in developing, training and educating legal department staff. Track and respond to updates and trends related to relevant statutory and case law and localized court policies and procedures. Assist in the creation of PPMS Policies and Work Instructions impacting the Legal Department. Document and log non-conformities with Director of Compliance. Assist in developing, revising and updating standard templates for pleadings and documents customarily used in Legal Department. Monitor processes, policies and procedures of other Company departments to evaluate potential impacts on the Legal Department and collaborate with General Counsel, Legal Department Supervisor and/or Director of Compliance to improve compliance, efficiencies and synergies. Meet Key Performance Indicators. Bachelor’s degree or equivalent is advantageous. JD degree from accredited law school. Strong knowledge of civil procedure in assigned jurisdictions, including Rules of Civil Procedure, Rules of firm Conduct, Rules of Evidence, and local court rules and processes is needed. Should possess a working knowledge of FDCPA, FCRA, TCPA and HIPPA. Must Possess a general understanding of relevant laws and issues related to bankruptcy, worker’s compensation, personal injury, contracts, insurance and Medicare/Medicaid. Trial experience is preferred.
