Counsel II The candidate reviews requests for information and subpoenas and prepares agency response, assuring legally appropriate protection of confidential information and compliance with Public Records Act and other laws. Prepares and presents legal memorandum to the Board of Registration in Medicine (Board) and its committees regarding the facts, law and options applicable to adjudicatory, policy, licensing, regulatory, legislative and policy matters; represents the Board in administrative licensing proceedings; drafts administrative and legal documents and correspondence; and performs related work as required. Receives requests for information and subpoenas, compiles and reviews responsive documents, and prepares agency response, assuring legally appropriate protection of confidential information and compliance with Public Records Act and other laws; receives and responds to telephone requests for information in a timely manner. Provides timely legal advice to Board members and agency staff in a large number of varied complex situations. Researches legal issues assigned by the General Counsel and keeps General Counsel informed as to pending legal issues and their resolutions. Compiles and prepares materials for Board and Committee meetings, including legal memoranda, draft orders, recommended decisions and proposed findings. Tracks legislation as requested by Board, Executive Director and General Counsel; prepares comments on draft legislation and regulations; assists in implementing statutory and regulatory compliance by the Board. Assists in researching, drafting, and implementing Board regulations, policies, and guidelines. Provides oral presentations to the Board on varied and complex matters. Assists in Division efforts to improve all aspects of data management, including paper and electronic files. Represents the Board at administrative licensing proceedings at the Division of Administrative Law Appeals in competent, prepared manner; presents relevant evidence and testimony; presents oral arguments utilizing effective oral advocacy skills; drafts pleadings; files motions, and legal memoranda. Prepares cases for administrative hearings by determining legal strategy and tactics to be used in individual cases; determining which witnesses will appear; preparing witnesses for testifying; ensuring that all testimony, other evidence and legal argument supporting the Board’s position is competently researched, prepared and presented; and performing other relevant tasks as assigned. Takes actions on behalf of Board (both independently and in consultation with the General Counsel and/or Executive Director) to implement general or specific Board directions. Performs legal review of staff documents and actions. Participates in Board outreach activities; provides training to others in laws, regulations, and Board policies and procedures. Attends relevant training's as required and keeps abreast of all relevant legal developments. Conducts self professionally in adherence to Massachusetts Law, Board regulations, policies, procedures and protocols and in compliance with Massachusetts Rules of Professional Conduct. Consistently represents the Board in a professional, competent, ethical manner. Maintains courteous, professional demeanor while working under occasionally stressful working conditions, including extended work hours at night and on weekends. Efficiently and effectively manages workload, prioritizing matters appropriately, setting and achieving goals and responding to deadlines in a timely manner. Adheres to strict legal and regulatory requirements of confidentiality and prohibitions against unauthorized disclosure of sensitive, confidential and privileged information. Maintains productive working relationship with Board staff and is responsive to supervision. Performs other related duties as required. Develops and maintains comprehensive understanding of agency procedures and systems relevant to successful performance of job duties. Performs such other general legal work as required. The candidate must have a Juris Doctor (J.D.) degree, admission to the Massachusetts Bar and 3 years of full-time, or equivalent part-time, professional experience in the practice of law. Ability: Ability to efficiently and effectively represent a government agency before administrative tribunals. Ability to prepare cases for administrative proceedings. Ability to maintain accurate records and assemble information in accordance with established procedures. Ability to conduct legal research and have knowledge of the rules of evidence and knowledge of code of professional responsibility. Ability to write concisely and effectively, expressing thoughts clearly and developing ideas in a logical sequence. Ability to exercise sound judgment. Ability to exercise discretion in handling confidential information. Ability to work independently. Ability to establish rapport and maintain harmonious working relationships with others. Ability to make effective oral presentations.
