Senior Claims Attorney - Compliance Duties: Minimize insured losses via proactive loss prevention efforts to collect overdue obligations prior to claim filing, working with our insureds and our network of domestic and international collection firms or local counsel. Review, evaluate and adjust claims. Determine coverage and policy compliance. Obtain and analyze claim documentation and information. Formulate claim decisions and formally present to FCIA’s Claims Committee. Ensure that claims are handled in compliance with legal and regulatory requirements. Communicate and negotiate with brokers, insureds and insureds’ counsel through all phases of the loss minimization, claims adjustment and subrogation/recovery process. Retain and direct outside counsel and consultants to maximize subrogation recoveries following claim payment. Manage claims department workflow, including the setting and periodic updating, as necessary, of loss reserves, maintenance of claims files, and periodic reporting to Senior Management. Respond to insured and broker inquiries on policy questions, pre-claim issues and claim related matters. Provide excellent customer service and maintain good relationships with brokers and insureds. Assist underwriters in manuscripting and negotiating policies and endorsements, advise underwriters on policy interpretation Assist FCIA’s General Counsel in drafting legal documents and new policy texts for new or existing products Assist FCIA’s General Counsel in legal and regulatory compliance matters including licensing requirements, form and rate filings and producer licensing.
Qualification and Experience
Qualifications: College degree, law degree and current admission to Bar. 5-10 years' related property-casualty insurance claim experience required, preferably in the contract surety, credit or other financial products line.†Strong communication, negotiation and interpersonal skills required for interacting with attorneys, brokers, insureds and debtors in a positive manner, building trust and customer loyalty. Self-motivated, with good analytical, problem solving and decision making skills. Demonstrated ability to work independently, with desire for hands-on involvement in the loss prevention, claims adjustment and subrogation/recovery process. Enthusiasm for working in a collaborative and team-oriented environment with a strong customer service commitment. Familiarity with commercial transactions and bankruptcy law preferred.
