Senior Counsel, Regulatory Law The candidate will provide legal support to client groups primarily in the pharmaceutical and medical device sectors. Will be responsible for providing legal advice on US government procurement and grant laws to business units (primarily pharmaceutical companies) receiving funding from US government for research and development and to business units (primarily medical device companies) selling to US government agencies. Research and development agreements with the National Institutes of Health and the Biomedical Advanced Research and Development Authority, as well as the sale of commercially marketed products to the Department of Veterans Affairs and the Department of Defense. Will advise on offers, compliance during contract performance, responses to government audits and inquiries, business strategies and compliance program activities, and ethics rules impacting interactions with government officials. Will provide support to government contracting teams, compliance organization, and legal colleagues. Scope of advice will include U.S. government-specific laws, regulations and proposed regulations as they may impact government procurements and grants, interactions with US government officials, and commercial contracting and marketing strategies.
Qualification and Experience
Qualifications: A JD Degree and admission to (and current good standing with) the Bar of at least one state or the District of Columbia and 5+ years post admission experience with a top law firm or comparable in-house experience in a government contracting practice is required. Strong facility working with the Federal Acquisition Regulation and agency supplements is required. Experience providing legal advice on government contracts is required, within health care industry is preferred. Excellent strategic and analytical skills, strong written communication and presentation skills, and the ability to work effectively both independently and on teams are required. Preferred: Experience advising clients on development of legally compliant strategies, internal policy development, and compliance program support and conducting internal investigations is preferred. Working knowledge of Buy American/Trade Agreements Act, small business subcontracting limitations, cost allowability rules, Anti-Kickback status, safe harbors, False Claims Act, is preferred.
