Deputy Public Defender The candidate: Monitors and manages a full case load; maintains and improves levels of competency through continuing legal education; and prioritizes workload, meeting deadlines required by rules or the court. Communicates with clients; establishes trust and rapport, explaining charges, constitutional and statutory rights and procedures. Determines whether client is fit to proceed; analyzes and educates clients of potential ramifications of guilty finding. Prepares clients and witnesses for trial and sentencing; obtains mitigating information for sentencing; explains judge's ruling and client's obligations and requirements. Reviews evidence and meet with clients regarding evidence, identifying key issues, defenses, witnesses; discloses defense discovery to prosecutor, as required by law. Investigates claims of alleged victims; interviews witnesses; inspects crime scene; directs and collaborates with in-house investigators. Analyzes and evaluates case, recommends options to client; consults with experts, coordinates and develops expert testimony; formulates trial strategy, organizes files and implements trial plan; and collaborates with second seat or co-defense counsel. Researches legal issues, interprets law, drafts motions and briefs regarding relevant legal issues. Prepares various pretrial and post-trial motions regarding legal matters, physical and mental health issues, addiction/recovery issues. Files notice of appeals, and prepare appellate briefs. Prepares documents to pursue post-conviction relief, habeas corpus proceedings and extradition matters. Appears at all required court proceedings as needed. Argues appeals at District Court and Idaho Supreme Court levels. Prepares case notes with sufficient description to permit another attorney to quickly familiarize themselves in the event they must stand-in. Collaborates with or acts as secondary attorney in complex cases or for trial. Assists other staff attorneys by exchange of ideas, suggesting actions and providing moral support; and coordinate with legal assistant. Explains involuntary mental health commitment process to mentally ill clients; represents parent in default of child support payments during civil contempt proceeding; and represents parents or children in proceedings to terminate a parent-child relationship. Works productively with outside agencies, including prosecuting authorities, probation departments, police departments, detectives, jail staff, treatment providers, Idaho Department of Health and Welfare, CASA, and schools; and serves as a team member in DUI Court, Drug Court, Mental Health Drug Court and Juvenile Drug Court, as well as community organizations requiring criminal law expertise. Public speaking and appearances in court for preliminary hearings, motions and trials. Performs these duties and responsibilities during scheduled work hours, shift differential, weekends and holidays as stipulated by Policy #210. Maintains a positive, helpful, constructive attitude and working relationship with the department supervisor and departmental employees, other County employees, Elected Officials and the public. Working knowledge and understanding of mental illness, DSM IV criteria, and treatment modalities; substance abuse/dependence and treatment modalities; and divorce and child support law is essential. Must possess excellent communication skills; and ability to work with high risk individuals that may be violent, in fast-paced, high stress environment. JD degree and 1+ year of related experience and/or training. Maintains continuing legal education credits to maintain standing with the Idaho State Bar. Must possess or have the ability to obtain a valid driver's license, and be insurable; First Aid card and CPR certification. License to practice as an attorney in the State of Idaho.
