Deputy City Attorney The candidate under the direction of the Attorney, represents the organization in civil and administrative litigation, negotiations, and other proceedings as requested. Also provides legal counsel and expertise to various organization departments, administrators and governing bodies; conducts legal research; and represents the interests of the city in all courts and judicial forums including both civil and criminal proceedings when required; as assigned by the City Attorney to assist other organization departments. Performs comprehensive legal research and prepares briefs as assigned by the City Attorney that may be required in all civil litigation proceedings including briefs for appellate court proceedings. Represents the organization in all assigned phases of a variety of civil litigation, hearings and presents arguments as required. Researches and prepares legal opinions concerning leases, deeds, easements, contracts, ordinances, resolutions and other issues submitted by the departments as requested. Develops, recommends and drafts policies and ordinances pertaining to required changes to any Code Chapter as assigned by the City Attorney. Provides professional advisory, litigation and administrative support services to organization Officials, departments, boards, intergovernmental entities and governing bodies. Advises the organization on issues concerning statutory interpretation, enforcement and case decision. Responds to public inquiries regarding municipal legal requirements, public records and consumer complaints. Maintains current knowledge of issues, legislation, regulations and case law in subjects related to municipal, civil and criminal law and affecting the organization (i.e., municipal government structure, operations, jurisdiction and issues, including to land use, utilities, personnel, tort liability and bankruptcy) Provides information and assistance to the public and refers to other departments or governmental agencies as appropriate. Prepares oral and written presentation and attends a variety of hearings, Council Committee meetings, departmental and board meetings, conferences and other gatherings as directed by the Attorney. Communicates courteously with, and establishes cooperative working relationships, with law enforcement, community and regulatory agencies and court personnel to coordinate efforts to assist in civil and criminal prosecutions when required, and to address community problems. Analyzes, evaluates and organizes case facts, evidence and precedents. Plans and organize work to meet established deadlines and goals. Performs related duties as assigned by the organization attorney. Supports the relationship between the City of Bothell and the constituent population by demonstrating courteous and cooperative behavior when interacting with clients, visitors, and City staff; enthusiastically promotes the City goals and priorities in compliance with all policies and procedures. Maintains absolute confidentiality of work-related issues, client records and City information; performs related duties as required or assigned.
Qualification and Experience
The candidate should have Juris Doctorate (JD) degree; and trial court experience; OR an equivalent combination of education, training and experience. Must be licensed by the Bar to practice law in the State of Washington, remain active with all Washington Bar annual requirements, and maintain a clear criminal record. Considerable municipal law experience with a focus on land use, public records, and contract review is preferred. Must have knowledge of: City policies and procedures. State of Washington criminal statutes, rules, case law, and applicable Federal rules and regulations. City Attorney's protocols and strategies of negotiation and litigation. Legal research and case management procedures, tactics, and techniques. Procedures and protocols for trial court, arraignment, and other legal proceedings. Legal research methods, techniques, sources, databases, and other research tools. Principles and protocols for the evidentiary gathering of information, documents, financial records, and other data that may be used in court, and rules of evidence. Duties, powers, authorities and limitations of a City Attorney, including rules of professional conduct and standards for ethical behavior. Principles, methods, materials, and practices of legal research. Should have skill in: Reading, understanding, interpreting and applying City, State and Federal statutes, codes and rules. Prosecuting cases in a courtroom, developing strategies, presenting legal arguments, and mediating legal issues. Using effective interrogative procedures and recognizing suspicious and deceitful behavior patterns. Reviewing and analyzing legal issues and documents. Analyzing and applying criminal laws to information, evidence, and other data compiled. Researching and identifying precedence in case law. Using initiative and independent judgment within established procedural guidelines. Establishing and maintaining effective working relationships and communications with court officials, City Council, community groups, employees, regional organizations, and the general public. Effectively representing the City in situations that are potentially adversarial or stressful. Assessing and prioritizing multiple tasks, projects and demands.
