ProfileCounsel, Financial Operations The candidate will be responsible for providing legal support to US Auto's automotive finance company including account servicing, bankruptcy, collections, insurance, recovery and repossession functions. This includes filing collections, recovery and other creditors’ rights litigation when necessary. Support the company’s General Counsel in drafting and reviewing business contracts, handling employment matters, identifying legal risk, reviewing real estate leases, and ensuring company compliance with consumer finance and protection laws. Coordinates legal strategy with business partners. Researches legal issues impacting legal strategy by identifying applicable statues, judicial decisions, codes, and legislative changes. Explains legal language in a manner understandable to business people. Files creditors' rights lawsuits. Assesses likelihood of recovery on defaulted accounts. Conducts judgment debtor examinations. Secures assets subject to enforcement of the judgment by levy, garnishment and other lawful judicial remedies. Handles bankruptcy matters from proofs of claims to motion practices. Manages non-attorney support staff. Files and defends general civil litigation claims. Drafts and review business related agreements. Performs other duties as assigned.
Qualification and Experience
The candidate should have Juris Doctorate degree from an American Bar Association accredited law school. Licensed to practice law in Georgia. Preferred: Bachelor’s Degree in Business, Finance or Economics and Licensed to practice law in South Carolina. Must have 2-4 years of experience in a law firm or corporate legal department with experience in consumer finance/collections. Experience preparing legal documentation and knowledge of FDCPA required. Previous automotive sales and finance law experience preferred. Experience with real estate transactions, business contracts, and/or intellectual property also preferred. Computer literacy to include Data Entry, Microsoft Word, Excel, & Outlook. Excellent Communication Skills (verbal and written) with the ability to communicate with multiple individuals, including attorneys, senior management, and business associates. Excellent legal skills and judgment including the ability to interpret and explain statues and regulations in plain English.
