Staff Attorney The candidate will report to Supervising Attorney. Works within a team of 2 attorneys, one BIA Accredited Representative and one paralegal, plus volunteer attorneys and law student interns to conduct legal intakes and consultations; provide direct legal representation to individuals and families living with HIV/AIDS; educate clients about legal issues and available services; provide outreach and legal training to other HIV services providers; supervise team members; manage the RW legal program; and comply with funders’ program and reporting requirements. Provide intake, counseling, advice and representation to HIV-positive clients in the practice areas of landlord/tenant, public benefits, immigration, family law, and advanced directives. Document files with progress notes, copies of correspondence, copies of pleadings, exhibits and all other case-related documents. Conduct thorough research and factual investigation and write persuasive legal memoranda and pleadings that are well supported with relevant exhibits. Prepare well for conferences, hearings, oral arguments, and trials. This includes knowledge of the rules of evidence and procedure, and the immigration court manual. Participate in trainings and read relevant statutes, regulations, rules, case law, memoranda and legal commentaries for the purposes of preparing cases well and staying current on developments in the program’s core practice areas. Build and nurture relationships with other HIV service providers and provide community education and outreach to such partners. Ensure compliance with funder requirements including: meeting targets completing required intake and reassessment/update forms, keeping time records, updating primary care measures, obtaining HIV diagnosis documentation, entering new clients into E-Share, and touching every active file at least once monthly; Comply with reporting requirements of the Ryan White grant, including monthly reports, and preparation for audits. Coordinate and supervise the RW team, including one BIA accredited representative and paralegal, as well as volunteers and legal interns. Participate in case conferences with supervisor and other attorneys in legal department. Share in the handling of legal intake and emergency legal problems along with other staff in the ASC legal department and work on a limited number of compelling pro bono cases. Collaborate with other ASC programs regarding mutual clients, to provide relevant updates and solicit case support. Requires JD degree from an accredited legal program and admission to NY Bar. Must have 2+ years of experience providing direct legal representation to high-need clients in the areas of benefits, housing, immigration and family law. Preference given to candidates with benefits law experience. Bilingual English/French, or bilingual English/Spanish is essential. Basic computer skills a must. Previous experience using eSHARE a plus.
