Profile

Managing Attorney The candidate will oversee the legal advocacy and environmental enforcement program. Will advance organization's mission to protect and restore the water quality and habitat of the San Francisco Bay region by identifying, evaluating, and implementing effective litigation and legal advocacy. Actively oversee investigative efforts to inform new litigation and advocacy. Serve as organization's lead in-house counsel and provide strong legal representation for organization through all phases of litigation, including filing, settlement negotiations, pleading, discovery, motion practice, briefing, hearing, and appeal. Build, manage, and maintain a complex, active, and balanced docket of 5-7 high-impact multi-year environmental law cases. Provide candid and well-informed assessments of the legal merits and risks of proposed litigation for senior staff, Legal Committee and Board of Directors. Lead organization's team of staff attorneys, law clerks, and outside counsel, including assignment of cases, advocacy efforts, and investigative work. Manage the operating budget for the Legal program by developing annual program budget, managing expenditures, updating budget forecasts throughout the year, and working directly with senior staff to manage multi-year earned revenue projections. Provide leadership in programmatic and organizational planning. Provide strategic advice for organization's field investigations, boat patrols, public records reviews, and other legal research. Report to the Executive Director and the Board of Directors on the status of litigation and case development. Help advance the professional development of organization's in-house counsel. Help maintain a cohesive and collegial organization team.

Qualification and Experience

The candidate should have admission to the California Bar. Must have 5+ years of litigation experience, including significant experience with case development, negotiations, brief writing, and oral advocacy. Docket management experience strongly preferred. Should have experience with the Clean Water Act and California Environmental Quality Act and state and federal civil procedure. Working knowledge of the Endangered Species Act, Public Trust Doctrine, Resource Conservation and Recovery Act, and other state and federal statutes is needed. Ability to effectively manage a small team of committed attorneys and advocates is essential. Desire to investigate pollution cases on the ground and on the water is required. Interest in taking a leadership role in a collaborative, visionary, and strategic organization is a must. Experience as an organizational spokesperson for external communications across a range of media and in a variety of advocacy venues is preferred. Comfort with and enthusiasm for traveling to meetings, public speaking, being on the water, and participating in fieldwork, including in inclement weather and/or outside of normal business hours an asset.
