Senior Legal Counsel, Marketing The candidate will be responsible for a wide range of legal matters arising from firm’s marketing initiatives and programs, including negotiating agreements with advertising networks/exchanges/DSPs, publishers, advertising agencies, production companies, and media partners. Will provide user privacy and data protection advice as it relates to marketing initiatives and advertising agreements. Conduct legal marketing communications (marcom) reviews and handle rights clearances and talent releases. Work closely and collaboratively with firm’s CMO and marketing organization. Work closely with Legal team colleagues around the world on marketing-related activities. Help plan for the Marketing Legal team over time.Working collaboratively with Marketing teams in support of initiatives and campaigns. Negotiating and drafting agreements with regional and global advertising agencies, advertising networks/exchanges/DSPs, publishers, production firms, media companies, talent, and rights-holders. Providing user privacy and data protection advice as it relates to marketing initiatives and advertising agreements. Advising Marketing team clients on media / content rights and any required clearances or talent releases. Conducting legal reviews of marcom. Drafting contest and sweepstakes rules as needed for Marketing team initiatives. Partnering with firm’s procurement and sourcing teams on marketing-related vendor agreements. Training clients and colleagues on marketing law issues. Serving as a subject matter expert within the company for advertising/marketing law issues, and staying up-to-date on marketing-related legal issues.

Qualification and Experience

The candidate should have significant experience with intellectual property (especially copyright and trademark), Internet, FCC, FTC, user privacy, advertising, sports, entertainment, licensing and contract law. Business-affairs related experience (including familiarity with union obligations and music licensing) a plus. Successful working in a company experiencing rapid change is required. Must have 6+ years of marketing legal experience, including support of complex marketing-related transactions, ideally with both a law firm and within a fast-paced technology, media, advertising agency, or Internet company. Must have a track record of success in working collaboratively with business clients in support of innovative advertising/marketing programs. Should have J.D. Degree and California Bar or New York admission in good standing (or qualified for and willing to apply for/maintain Registered In-House Counsel status with California or New York State Bar).
