Senior Counsel, Labor & Employment The candidate will advise the Human Resources on employment law matters under federal and state laws (e.g., Title VII, ADEA, ADA, FMLA, FLSA, NLRA). Monitor legal developments to ensure compliance with federal and state labor and employment laws. Draft and revise policies. Investigate employment law claims to respond to EEOC Charges, State Agency Charges, and Claims under the Company’s Employee Dispute Resolution Plan. Litigate claims under the Company’s EDR Plan, including written discovery, taking and defending depositions, conducting arbitration hearings, and drafting post-hearing briefs. Draft responses to Charges and Claims and representing the Company in administrative proceedings. Draft mediation statements, handling mediation, and negotiating legal settlements. Conduct compliance training. Engage outside counsel in an effective and cost-effective manner and managing litigation. Assess legal risk and making recommendations to senior management. Travel on a regular basis to attend mediation and hearings and to conduct training. J.D. from an accredited law school and license to practice law and in good standing in any U.S. state required. Demonstrated knowledge of, experience in, and interest in all aspects of employment law required. 5+ years of professional law practice experience (law firm and/or in house) with primary focus in Labor & Employment law required. Experience with union facilities is a plus. Knowledge of California employment laws preferred. Excellent communication skills, oral and written, with the ability to synthesize complex legal issues to their essential elements required. Demonstrated experience, comfort and confidence to interact and relate well within a legal department, and build trusting relationships with HR and the senior leadership of company’s operating units and subsidiaries required. Demonstrated ability to analyze complex legal issues, measure legal risk, and communicate guidance to management required. The ability: to supervise and manage outside counsel; to prioritize responsibilities, to work efficiently, to manage and to conclude, in a timely manner, many projects, issues, and cases required.
