Senior Counsel, Employment Law The candidate will provide a significant amount of counseling to human resources, responding to administrative charges, reviewing and/or drafting employment policies, reviewing bonus plans, negotiating and drafting employment agreements and other employment-related agreements (i.e., independent contractor, confidentiality, non-competition, etc.), conducting wage and hour audits, overseeing responses to subpoenas, and overseeing outside litigation, including responding to discovery demands, attending depositions and/or trials and resolving cases.
Qualification and Experience
The candidate should have 5-7 years of experience practicing law, with 5+ years of experience as outside counsel handling defense-side employment litigation and counseling matters. Should be fully versed in US employment-related laws and legal issues, including: Title VII, FMLA, ADA, ADEA, FLSA compliance, wrongful termination, retaliation, harassment, reductions in workforce, classification of employees, labor /union relations and restrictive covenants. Must have experience of providing training with respect to employment law, including anti-harassment training and have an in- depth understanding of issues related to independent contractors. First or second chair trial experience is required. Experience in training human resources and/or supervisory staff needed. Prior in-house experience is a plus. Plus factors include labor relations experience, hospitality industry experience, call center operations/employment relations experience, international employment law experience and proficiency in Spanish.
