Attorney Iv The candidate in this classification independently perform the more complex and sensitive legal services with broad discretion. Assignments involve novel theories and/or practice involving rapid evolution of law, legal area specialization, legal expert, precedential value and involve opposing counsel or representatives who have a high level of experience and specialization. Under the general direction of the Chief Counsel of the Department of Industrial Relations (CEA) and the Assistant Chief Counsel, the Attorney IVs are highly experienced and qualified attorneys in the Department. They represent and advise the Director of the Department and the various Division Chiefs with regard to policy, program direction and legal matters. Will be expert in the breadth and complexity of industrial relations law as well as sufficiently specialized to lead and monitor teams within a particular area. Perform complex administrative and civil (trial level and appellate) litigation work. Assignments typically consist of litigation, holding hearings, legal research and opinion drafting; rendering legal advice and opinions to department management; responding to difficult legal correspondence; and developing strategy and tactics in the most complex disputes or litigation and, for proceedings involving other departmental counsel, monitoring ethical, conflict-of-interest and ex parte rules. Will be required to take substantial initiative, exercise a considerable amount of discretion, display superior work habits (e.g., organizational skills, accountability, timely completion of assignments), work independently, and produce the highest quantity and quality of legal work. Attorney IVs serve as lead counsel over less experienced staff in either ad hoc litigation or as team leader. As hearing officers in certain areas, they may report directly to the Director. Attorney IVs in the Office of the Director Legal Unit are assigned the following responsibilities: Represent the Director and Division Chiefs in administrative and state and federal trial and appellate forums in litigation involving one or more of the following substantive areas, with a concentration on item (4) on the general range of representation listed below:California apprenticeship laws. California public works laws, including prevailing wages and apprenticeship. Self-Insured (Workers’ Compensation) Plans. Employment law (Government Code, Title VII, FEHA, Americans with Disabilities Act, Age Discrimination in Employment, Unemployment Insurance Code, Labor Code) related to Department personnel matters before the State Personnel Board, Department of Personnel Administration, Equal Employment Opportunity Commission, Department of Fair Employment and Housing, Unemployment Insurance Appeals Board, and related civil litigation. Labor-management laws (Public Utilities Code) governing county transit districts for the State Mediation and Conciliation Service in state trial and appellate courts. Information Practices Law. Cases challenging the validity of Labor Code provisions under the state or federal constitutions, or federal laws. Act as Hearing Officers for the Director including workers’ compensation, public works, prevailing wage, self-insurance plans, apprenticeship, and State Mediation and Conciliation cases. Advise the Director and Division Chiefs on rulemaking, legislation, and general policy issues; testify before legislative bodies; serve as counsel to boards appointed by the Governor; train other counsel and staff; and, lead and monitor work of specific substantive area legal teams within the Unit. Representation of the Director as Administrator of three workers’ compensation funds (the Uninsured Employers’ Benefits Trust Fund, Subsequent Injuries Benefits Trust Fund and the Death Without Dependents Unit) before the Workers’ Compensation Appeals Boards, Reconsideration Unit, and civil appellate courts throughout California. Serve the public by performing the following tasks which include: study, interpret, and apply laws, regulations, court decisions, and other legal authorities; perform a wide variety of legal research; provide advice or opinions to departmental management or members of the public on legal issues arising out of the programs of the department in which the incumbent is employed and of the legal effect of rules, regulations, proposed legislation, statutory law, court decisions, and administrative actions; respond to legal correspondence; conduct special investigations involved in the enforcement of state laws and departmental rules and regulations; develop proposed legislation; testify before legislative committees; prepare or assist in preparing cases, opinions, briefs, and other legal documents such as memoranda, digests, summaries, and reports; assist in the preparation of or have responsibility for preparing cases which may result in litigation before boards, commissions, hearing officers, administrative law judges, or trial or appellate courts; develop strategies and tactics in disputes or litigation; assemble and evaluate evidence; secure and interview witnesses; conduct negotiations; represent departments in hearings and litigation; may act in a lead capacity over lower level attorney staff; and perform other related legal work. Can move into a supervisor/management career path through the Supervising Attorney, Assistant Chief Counsel, or Chief Counsel classifications.
Qualification and Experience
The candidate require active membership in The California State Bar. (The candidate who are not members of The California State Bar but who are eligible to take the California State Bar examination or are in their final year of law school will be admitted to the examination). Must have 10 years of legal experience in the practice of law, 4 years of which must have been at a level of responsibility equivalent to an Attorney III. (The candidate who have completed 9 years and six months of the required total legal experience including 3 years and six months of the required legal experience comparable to the Attorney III class will be admitted into the examination but must complete the required ten years' total legal experience.). Must have knowledge of: Legal research methods and performing research; legal principles and their application; scope and character of California statutory law and of the provisions of the California Constitution; principles of administrative and constitutional law; trial and hearing procedure; and rules of evidence; court procedures; administrative law and the conduct of proceedings before administrative bodies; legal terms and forms in common use; statutory and case law literature and authorities; and provisions of laws and Government Code sections administered or enforced. Should have ability to: Research; analyze, appraise, and apply legal principles, facts, and precedents to legal problems; analyze situations accurately and adopt an effective course of action; prepare and present statements of fact, law, and argument clearly and logically in written and oral form; prepare correspondence involving the explanation of legal matters; draft opinions, pleadings, rulings, regulations, and legislation; negotiate effectively and conduct crucial litigation; work cooperatively with a variety of individuals, organizations and maintain the confidence and respect of others; and work effectively under pressure.
