Assistant General Counsel, Global Intellectual Property-Chemical/Pharma The candidate will be responsible for preparation and supervision of original patent applications, patent prosecution, non-infringement/freedom to operate opinions, and interaction with the U.S. Patent and Trademark Office. Will support several lines of business including in-center and at home dialysis equipment, as well as firm’s integrated care initiatives. Direct, maintain, manage and protect the intellectual property portfolio of Fresenius Medical Care while ensuring compliance with company policies and procedures and applicable government regulations. Responsible for all items and functions pertinent to: Preparation of 10-12 Patent applications or equivalents per year, focusing on integrated care, business methods, and methods of treatment; Non-infringement and freedom to operate opinions as directed; Intellectual Property licenses and other IP related agreements as required. Coordinate closely with product research and development personnel and facilities in all subsidiaries and with patent department(s) at related foreign affiliates to ensure the appropriate documentation, processes and procedures are followed. Review intellectual property portfolios of competitors and develop intellectual property strategies to maximize and protect the Company’s competitive position. Supervise and direct the work activities of law department personnel employed to assist in the above legal duties and responsibilities.
Qualification and Experience
The candidate should have a Bachelor of Science degree in Bioengineering, Chemical Engineering, Chemistry or related discipline. A graduate degree (MS, PhD) would be a plus. Technical degree a Bachelor’s in Mechanical or Electrical engineering, and advanced technical study preferred. Should have Juris Doctor Degree, be member of a State Bar, member of US patent bar (Registered at US Patent and Trademark office). Must have 2-5 years of related experience, with outside-the-box thinking on patentable subject matter. Knowledge of applicable regulations, executive orders, precedents, and legal codes essential.
