Labor and Employment Attorney Duties: Manage the company’s labor and employment issues throughout the Americas (primarily the U.S., but also Canada, Mexico, Latin America, and South America). Provide practical advice and counseling regarding labor and employment issues, including acquisition due diligence, discrimination, disability accommodation, hiring, discharge, wage and hour, performance management, employee privacy, non-compete and confidentiality agreements, OFCCP matters, legal documents & policies related to employment legislation, and all other relevant topics. Additional responsibilities include, but are not limited to, managing litigation, government agency investigations, labor union negotiations, audits and administrative charges, responding to grievances under collective bargaining agreements, developing and delivering employment law related training and counseling the business unit leaders on best practices related to compliance under all local, state and federal discrimination laws. Counsel business segment management on recommended legal practices, contractual terms and conditions, and serve as project manager on assignments. Under the direction of the VP and General Counsel, organize and manage corporate employment activities to protect the company’s interests, minimize risk, and maximize profit by initiating appropriate legal action when faced with employee disputes and challenges. Ensure the company is in compliance with all collective bargaining agreements. Participate in the negotiation of all contracts in conjunction with leadership to ensure that the approved contract is fair and represents the interests of both the company and the union employees. Participate with Company management on responding to union grievances. Provide legal counsel and guidance in all labor and employment areas of the company's business. Perform the necessary research and investigation in developing opinions for such counsel and guidance on topics such as working conditions, safety, workers’ compensation, Americans with Disabilities Act (ADA), Title VII of the U.S. Civil Rights Act, FMLA, disciplinary actions, and employee complaints and grievances. Review the company’s Ethics Hotline on a regular basis and works closely with HR Business Partners to investigate and resolve all reported matters on a timely basis. May provide training to managers and employees on the intended use of the Company’s Hotline to increase awareness and proper reporting. May assist VP, HR to prepare for and report complaints/issues to the Audit Committee of the Board bi-annually. Review all government charges (EEOC, Pennsylvania Human Relations, etc.) and lawsuits against the company brought forward by third party attorneys related to any and all employment matters. Conduct comprehensive investigations in collaboration with assigned HR Business Partner and draft position statement responses. Review all employment terminations in advance to ensure proper documentation has been submitted in support of the decision and that legal risk has been mitigated. Provide a legal review of all Reductions in Force (“RIFâ€) including an adverse impact analysis to ensure we have selected the correct individuals for position elimination and have not discriminated against any individual. Review the language in all Separation/Release Agreements along with the OWBPA Disclosure documents to ensure full legal compliance. Review hiring decisions (e.g., failed background tests, drug screens, employment tests) and advise management on the recommended decision regarding the candidate. Review the data in our annual Affirmative Action Plan (AAP) before it is finalized and make suggestions to our Employee Relations and Recruiting teams on what areas we should focus on. Collaborate with and coordinate outside counsel as required to obtain legal opinions and assistance related to a variety of employment legal matters that cannot be addressed or resolved through internal resources. May be required to manage relationships with outside law firms providing services to the company. Assist outside Immigration attorney with questions related to expat/inpat visas, taxation, relocation, etc. Actively review pertinent new employment case law and newly enacted Federal and State statutes and regulations to assure corporation complies with all provisions of such law. Provide legal briefings/updates to HR Department staff and business managers on these new laws and regulations. May assist in drafting new HR policies or revising/reviewing existing ones to ensure that the company is legally compliant at all times with respect to our employment practices on a Federal/State/Local basis. May assist the General Counsel or the corporate legal team in the development, deployment and monitoring of company-wide compliance policies, including subjects related to Anti-Corruption, Insider Trading, U.S. Trade Control, etc. and the training of applicable employee groups enterprise-wide. May help develop and deliver required HR and legal training on a variety of topics, including state employment laws (sexual harassment in CA, paid sick leave in a variety of states/cities). Assist in the development of broader legal strategies to help effectively position the Company for future employee growth both domestically and internationally. May speak on behalf of the company at conferences or employee relations events.
Qualification and Experience
Requirements: JD Degree. Advanced degree (MBA, Master’s) preferred. Admitted to practice law in the Commonwealth of Pennsylvania while maintaining membership in good standing. 8+ years progressive labor and employment law experience required; including a mix of law firm and in-house experience. 5+ years in a leadership role (direct or indirect). ERISA benefits background helpful. High degree of proficiency MS Office Suite, Outlook & Internet applications. Strong analytical, prioritizing, interpersonal, problem-solving, presentation, budgeting, project management (from conception to completion), and planning skills. Strong verbal and written communication skills (including analysis, interpretation, and reasoning). Solid understanding and application of mathematical concepts. Ability to develop and maintain collaborative relationships with peers and colleagues across the organization, as well as, internal and external clients. Ability to work well autonomously and within a team in a fast-paced and deadline-oriented environment. Ability to work with and influence peers and senior management.
