Senior Legal Counsel, ERISA Fiduciary Responsibilities: Providing legal advice and guidance to Company and affiliates related to ERISA fiduciary topics and associated legal principles. Provide ERISA fiduciary expertise, directly or through team members, for: a) distribution of proprietary investment management products and services products through institutional and individual retirement plans and accounts; b) investment management of ERISA-governed assets. Support product development efforts requiring specific ERISA expertise. Articulate legal positions for external audiences (clients and their counsel) on fiduciary topics as needed. With colleagues, develop legal interpretations and positions on new and emerging legal and regulatory developments affecting retirement plans and accounts. Legal Support for Product Development Efforts. Responsible for providing legal advice and guidance on a retirement fiduciary and tax legal principles in support of products and services under development for retirement plans, participants and advisers. Legal Support for Infrastructure Technology, Policy and Business Projects Relative to Delivery of Products and Services to Retirement Plans, Participants and Account Holders. Responsible for identifying legal questions arising in connection with infrastructure projects, leading delivery of legal advice in fiduciary and retirement tax arenas, and coordinating with legal department colleagues to insure delivery of relevant legal advice on areas outside of retirement fiduciary and tax areas. Legal Support for Implementation of New Retirement-Related Laws and Regulations. Responsible for providing legal counsel in connection with implementation of new retirement laws and regulations.
Qualification and Experience
QUALIFICATIONS: Law Degree from accredited School of Law. Active member in good standing of the bar of a United States state or jurisdiction. Senior attorney with 10+ years of industry experience in a firm providing retirement plan services such as mutual fund complex, insurance company, broker-dealer, or law firm. Must have in-depth, specialized knowledge of legal rules governing retirement plans. Preferred: Strong working knowledge of retirement plan service provider operations and general business requirements, as well as the fund distribution business. Strong oral and written communication skills. Strong interpersonal and collaborative teamwork skills. Strong leadership and management skills. Good negotiating skills. Knowledge of ERISA fiduciary principles as well as other principles under which retirement plans (qualified, nonqualified, defined contribution and defined benefit plans) and retirement accounts operate, including Internal Revenue Code and applicable securities laws.
