Attorney The candidate will: Under the general direction of the Assistant General Counsel for the Office of Legal Affairs' Workers' Compensation Team (WCT), will generally provide legal, technical and administrative advice and assistance to the various components of the human resources and risk management systems of the California Department of Corrections and Rehabilitation ('CDCR'). Will be responsible for the provision of legal advice and support to the Office of Employee Wellness, and the Workers’ Compensation Unit (WCU), the various field Return to Work (RTW) Coordinators and Health and Safety Officers and to the CDCR managers involved in resolving employee medical issues and requests for reasonable accommodations. Will represent the CDCR before the State Personnel Board (SPB) on administrative appeals of medical actions, constructive medical actions and complaints of disability discrimination. Will be responsible for assistance in the provision of training regarding employee medical issues. The position requires periodic statewide travel. Provides direct house counsel support and legal advice to the Office of Employee Wellness, and the WCU, the various field RTW Coordinator and Health and Safety Officers and to the CDCR managers involved in resolving employee medical issues. Give advice on issues regarding the drafting of policies and procedures relevant to the management of employee medical issues. Assist in the delivery of training to the components of the CDCR that deal with employee medical and RTW issues. Prepares for and litigates SPB hearings involving allegations of disability discrimination, constructive medical termination or suspension and failures to provide reasonable accommodation, and, on occasion, complaints of discrimination, harassment and retaliation. Assist the CDCR managers with settling the SPB cases and in developing strategies to resolve adverse decisions. Serves as the CDCR’s case manager and liaison with the Office of Attorney General for employment lawsuits alleging disability discrimination or failure to provide reasonable accommodations, and, on occasion, complaints of discrimination, harassment and retaliation. Assists the assigned Deputy Attorney General or outside contract counsel in identifying sources of information and discovery. Approves requests for retention of expert witness and approves bills for legal services. Prepares the appropriate documentation to obtain settlement authority and attends mediations, arbitrations and settlement conferences as the CDCR’s representative. Assists the CDCR managers in resolving policy issues identified during the course of litigation. Responds to questions from the various human resources components of the CDCR and provides legal advice on a wide variety of personnel issues and policies and on legal issues for which the staff counsel has developed a legal expertise.
