Profile

Part-time Assistant County Attorney Duties: Will perform professional legal work assisting the County Attorney in performing duties as legal counsel and criminal prosecutor for organization. Perform each and every duty listed below on a regular basis. However, each incumbent must be able to perform all duties of the County Attorney's Office. Maintain liaison with the courts and other public agencies. Assure adherence to office policies and procedures. Identify and evaluate legal issues and evidence. Develop and formulate legal strategy and remedies. Determine appropriate criminal charges after reviewing and evaluating investigative reports, including follow-up communication with investigating officers. Make all criminal court appearances including Rule 5, Rule 8, bail hearings, pretrial, contested omnibus, settlement conference, trial, sentencing, restitution, probation violations, review hearings and post conviction relief hearings. Prepare trial briefs, appeals, warrants, summonses, complaints, petitions, extradition requests and other legal documents necessary for prosecution and trial. Prepare and try criminal and civil cases in district court under applicable ordinances and statutes. Prepare appeals and respond to motions for new trial. Prepare and present cases dealing with juvenile welfare, juvenile certification, extended juvenile jurisdiction, children in need of protection, termination of parental rights, paternity , child support enforcement , zoning and land use matters, and other issues as required. Provide legal guidance to child protection team with regard to maltreatment and abuse determinations, and represent Human Services in appeals of said determinations. Represent the county in Mental Health Commitment proceedings by reviewing pre-petition screening reports, medical and psychological reports, drafting petitions, appearing at detention, probable cause, commitment and involuntary neuroleptic medication (Jarvis) hearings. Assist in providing legal counsel to County Board and other county officials and employees concerning county matters, including representation of employees subpoenaed to give testimony. Advise and provide periodic training to county employees related to data practices law. Review law enforcement agency polices and procedures to insure compliance with changing statutes, rules and case law. Provide training to law enforcement officers and issue advisory memoranda explaining complex points of criminal procedure and criminal law. Provide relevant information to the general public as needed or requested. Review Human Services reports and initiate civil actions related to paternity, child support, and contempt. Draft pleadings including summons, complaints, motions, orders to show cause, findings of fact, conclusions of law, orders for judgment, affidavits, wage withholding orders and garnishment documents. Determine appropriate remedy for reimbursement of costs associated with out of home placement, medical assistance and treatment of children. Draft pleadings and appear in court to seek requested relief. Handle on-call responsibilities for weekends and official holidays on a rotating basis with other attorneys. Develop and maintain respectful and cooperative working relationships. Regular attendance according to the department's work schedule. Perform other duties may be required and assigned.

Qualification and Experience

Qualification Requirements: The candidate should have a Juris Doctorate degree from an accredited law school. Must be licensed to practice law in the State of Minnesota. Valid MN driver's license while operating vehicle on county business. The ability to communicate effectively and professionally with other attorneys, judges, Human Services' staff, law enforcement, probation officers, court personnel, other county employees, expert witnesses, offenders, victims, witnesses and the public. The ability to make effective presentations to large and small groups as required.
