Senior IP Counsel The candidate will report to and work closely with the VP of Legal Affairs (General Counsel). Provide day-to-day IP support to the generics business regarding portfolio identification and product selection, work closely with the research & development group in connection with product development, draft regulatory submissions, and provide IP support to the commercial function, e.g. product launch. Manage outside law firms in connection with Paragraph IV litigation. Oversight and management of PIV litigation including document collection, coordinating e-discovery, providing substantive input on defense theories, litigation strategy throughout case cycle, and settlement strategy. Oversight and management of opinions, notice letters, patent and exclusivity certifications, and litigation holds, and custodian interviews. Provide IP landscape and other analysis for various business units with respect to products identified by business development and/or R&D; work with formulators. Assist in management, coordination and development of patent and trademark prosecution portfolio. Provide regulatory support and general patent counseling.

Qualification and Experience

The candidate should have a Juris Doctorate Degree and admission to and in good standing with the Bar of at least one state (preferably New Jersey) and eligibility to practice law in-house in New Jersey. Experience performing IP due diligence and providing IP due diligence reports associated with corporate transactions (mergers, acquisitions, joint ventures) preferred. Significant understanding of the overall regulatory framework under which a generic manufacturer generates ANDA and 505(b)(2) filings. Strong academic credentials, including a Bachelor’s Degree in a relevant scientific background (chemistry, biology, biochemistry, chemical engineering, pharmacy). An advanced scientific degree is preferred. 6+ years of experience with pharmaceutical patent clearance, opinion, and Paragraph IV litigation experience (prior in-house experience working for a generics company preferred). A license to practice before the USPTO (or eligibility to become licensed) is required. Able to demonstrate the ability to provide sound, ethical legal advice on a broad range of issues affecting the Company. Excellent organizational, presentation, and oral and written communication skills are required. Strong ability to coordinate project, balance multiple priorities and work with cross functional groups is required.
