Senior Corporate Counsel, EHS The candidate will be part of a small team of attorneys, and work closely and independently with a diverse range of internal clients on all aspects of EHS law. Will direct and manage outside counsel retained to support the company’s EHS legal needs. Responsible for providing legal advice to Company affiliated EHS departments, manufacturing operations, engineering and facilities, real estate/planning, research, and other site organizations and businesses. Advising and representing the Company on complex EHS compliance and enforcement matters, including those arising under federal, California, and other state and local EHS laws and regulations on hazardous waste, hazardous materials, air emissions, wastewater, storm water, radioactive materials, process safety issues, and occupational safety and health. Analyzing issues, developing strategy, and managing complex site remediation- related matters and activities including state and federal Superfund sites. Coordinating environmental due diligence activities and providing legal support for site acquisition and development, divestitures, and other real property-related matters. Partnering with Company transactional attorneys and diverse internal stakeholders to prepare and negotiate EHS provisions of transactional documents. Preparing, reviewing, negotiating, and advising upon EHS-related contract documents, and EHS aspects of vendor relationships. Partnering with representatives of other departments on internal investigations, including, for example, accidents and worker injuries. Contributing to cross-functional or departmental projects and teams. Managing outside counsel retained to support EHS legal matters. Advising on various EHS programs and procedures.
Qualification and Experience
The candidate should have a J.D. with Bar admission and 10 years of EHS law experience; experience can be at law firm, corporate in-house setting, governmental authority, or a combination; 5+ years’ experience at a law firm and/or corporate in-house setting is desirable. Excellent knowledge and prior practice of major California and federal EHS laws and regulations is required. Prior experience providing EHS regulatory compliance advice to industrial clients, preferably to the pharmaceutical or biotech industries is needed. Should have experience with multi-party site cleanup litigation. Working knowledge of real estate and/or land use law desirable. Experience with federal and/or Cal-OSHA desirable. Outstanding communication skills, both oral and written are needed.
