Corporate Counsel, Global Privacy and Data Protection Candidate will lead the legal approach to privacy and data protection at company, bridging legal, technical and business worlds as partner with the business teams and your legal colleagues to introduce new technologies, business models, compliance approaches and meet customer needs. Advise on compliance and best practices across all aspects of global privacy and data protection law and regulation, including consumer data use and sharing, behavioral advertising and analytics, data retention, data security and data breach. Partner with stakeholders throughout the company to advise on data security and privacy matters. Lead the legal aspects for implementation, maintenance, and continuous improvement of the Company’s privacy and data governance programs to ensure continued compliance with privacy and data protection laws globally. Implement, maintain, and evolve company’s data protection program including company’s privacy policies and procedures in cooperation with team members from the legal team, business units and information security groups. Perform periodic privacy risk assessments and conduct related ongoing compliance monitoring activities in coordination with the other compliance and operational assessment functions. Work with legal team, management and key departments to ensure the company has and maintains appropriate privacy consent, authorization forms and information notices and materials reflecting current organization, business practices and legal practices and requirements. Support product development, education, sales, information systems, business models and marketing and litigation and compliance groups on privacy related matters. Oversee and ensure delivery of relevant privacy awareness training and orientation to all employees. Collaborate with the company’s Chief Information Security Officer in reviewing system-related information security plans through the organizations’ network to ensure alignment between security and privacy practices. Partner with Government Affairs on establishing and maintaining company’s positions on key policy matters relating to privacy and data security and create relationships with peer companies and privacy subject matter groups. Lead legal participation in anticipating and responding to privacy and security incidents and participate in company’s incident response teams related to privacy. Lead privacy working group within the worldwide legal team. Work across business and development teams to find creative solutions to meet privacy and data protection initiatives. Coordinate with Government Affairs, legal and business teams on both internal and public policy development. Will follow global data privacy legal trends including in the areas relating to marketing, consumer businesses, children and education and partner with internal and external policy experts to impact company’s position.
Qualification and Experience
Candidate should have J.D. degree from ABA accredited university and membership in good standing of the California Bar. 10+ years’ relevant experience in a law firm and/or corporate department is essential. Prior in-house experience with a global public company and or experience working with Internet or high tech companies is preferred. Expertise with privacy and data protection laws in the US and globally, and ability to advise company executives on regulatory matters, as well as assist with evaluating company compliance on privacy issues is required. Familiarity with cloud and mobile business drivers is a plus. Should be familiar with privacy and data protection laws relating to children and educational institutions. Should have deep privacy and data protection expertise. Should have substantial experience with global data privacy laws and their practical application when it comes to B2B customers and end users, as well as consumers, students, children and employees. Should also be familiar with data privacy issues across multiple platforms (desktop, mobile and cloud).
