Assistant General Counsel - Compliance The candidate responsible for ensuring firm’s policies, procedures, products and business operations comply with applicable state and federal laws. Will serve as the company HIPAA Privacy Officer for matters relate to HIPAA privacy including breaching notification, investigations; data use policy and procedure development and required education. Serve in creation and ongoing operation of the Corporate Compliance Plan (including the Medicare Compliance Plan); the Regulatory Compliance Request online Q&A process; annual compliance and other specialized training; all materials and documents required to maintain the organization’s licensure. Manage a team of attorneys who analyze and interpret a variety of corporate, regulatory and government compliance and regulatory requirements. Understand, interpret and apply pending and effective state and federal laws. Draft and review policies and procedures for consistency in all of the following areas: legal and regulatory compliance; relevant business decisions and fact circumstances; use of correct terminology and overall readability. Identify compliance issues/possible violations, assess risks and limit firm’s liability. Respond to complaints and reports of misconduct through appropriate investigations and escalations. Lead the investigative process and if required, serve as the liaison with the regulatory agency. Serve as a legal resource to firm’s employees regarding compliance concerns. Prepare and present quarterly reports on compliance risks and team activities to executive leadership. Assist with benefit interpretation. Serve as the HIPAA Privacy Officer. Assist with investigations and respond to complaints and breaches involving protected health information (PHI). Assist in developing and maintaining an organizational culture committed to the protection of PHI and nonpublic personal financial information, via effective policies and procedures, workforce education and business solution development. Develop template business associate, business associate subcontractor and data use agreements and negotiate with contracting parties as needed. Represent firm’s compliance interests on internal and external committees, including, as applicable, committees that handle requests for the use and disclosure of PHI. Actively manage and motivate staff. Supervise the team’s workload, assign individual work, review work product and provide constructive feedback. Conduct performance reviews, set career goals and support staff development. Manage to budget. In conjunction with other division leaders, develop and support initiatives to improve divisional performance. Work closely with the Internal Audit Services team to mitigate risk and prepare for regulatory audits. Manage projects and participate in team activities to identify problems and improve work processes and systems. Work closely with firm’s system entities on matters that involve data sharing across entities. Impart the mission, values and vision of SSM Health Care and facilitate the integration of t values in Continuous Quality Improvement (CQI) activities. Understand, embrace, and practice the principles of CQI in utilizing the criteria as a means to achieve performance excellence. Follow internal policies, standard operating procedures, and provides a personal example of CQI leadership effectively applying the seven principles of the SSMHC philosophy and expectations to carry out the duties of the position. Participate on a variety of committees. Other duties as assigned.
Qualification and Experience
The candidate should be Licensed Wisconsin attorney with 3+ years of work-related industry experience, particularly in managed care, healthcare compliance and corporate audit. Prior supervisory experience is needed. Experience in process improvement, development of policies and procedures, and implementation of legal requirements in business operations is preferred. Preferably 2+ years of supervisory experience. Knowledge of HIPAA privacy laws and other state/federal laws that govern firm’s business, including Medicare and Medicaid lines of business.
