Counsel II Duties: Advises staff on legal matters by interpreting laws, rules, regulations, as well as judicial, quasi-judicial or administrative decisions related to agency operations. Conducts legal research on matters related to agency functions and prepares legal opinions. Reviews all outside section language of the budget and opines and/or makes recommendations to the Superintendent on subsequent effects/impact. Reviews and participates in formulating agency policies and as a member of the leadership team recommends/advises on policy decisions. Review and interpret contracts, memoranda of agreement, interagency service agreements, and other documents on behalf of the agency. Will be involved in labor relations matters that include responding to employee grievances, conducting disciplinary hearings, and making recommendations for disciplinary action. Will work with the labor and legal teams of the Office of Employee Relations and Human Resources Division by assisting in the preparation and presentation in the defense of unfair labor practice allegations and arbitrations brought by unions under collective bargaining agreements. Will respond to allegations brought forth by the Massachusetts Commission Against Discrimination. Represents the agency at administrative hearings; assists in the defense or prosecution of cases by the Attorney General’s Office, represents the agency in court under the aegis of the AG’s Office as a Special Assistant Attorney General as appropriate, and acts as a liaison with AG’s office on suits filed in Federal and State Courts. Reviews tort and other claims and interviews agency personnel to obtain information regarding such claims. Pursuant to any negotiations, they consult with the General Counsels of the Department of Veterans’ Services and the Executive Office of Health and Human Services regarding proposed settlements and/or appeals of administrative and judicial decisions. Confers with agency staff and the Department of Veterans’ Services in reviewing proposed legislation to determine its impact on agency functions.

Qualification and Experience

Qualifications: JD degree, admission to the Massachusetts Bar and (A) 3 years of full-time, or equivalent part-time, professional experience in the practice of law.
