Corporate Counsel Duties: Responsible for managing litigation of labor and employment disputes, administrative hearings and investigations; working closely with business colleagues, outside counsel and insurance carriers; drafting and reviewing documents and handling legal questions regarding PEOs, payroll, benefits and HR services; providing advice and delivering resolutions to complex legal issues in the areas of Title VII, ADA, ADEA, FMLA, and FLSA; and handling miscellaneous business and employment matters referred to the Legal Department. Work closely with and oversee outside counsel in handling TriNet and TriNet customer litigation pending in federal and state courts and arbitration tribunals. Work closely with insurance carriers regarding handling of TriNet and TriNet customer litigation, administrative matters, etc. Assist in the handling of administrative charges pending with the EEOC, DOL, WCAB, and other state agencies, including fact investigations and document reviews, drafting and submitting position statements, and preparing for appearances before such agencies in hearings or mediations. Assist with processing of subpoenas and data security issues. Draft employment-related policies and address process and policy issues and provide guidance and recommendations for optimal resolution. Review requested changes and draft amendments to service contracts for prospective customers, proposed vendor contracts and real estate leases. Research and respond to questions from business colleagues related to legal requirements for PEOs, payroll, benefits and HR services. Provide advice and counsel in the areas of Title VII, ADA, ADEA, FMLA, FLSA, WARN Act, and related state and local laws, as well as employment-related claims, contract issues, common law claims, and non-competition/non-solicitation matters. Provide education and guidance to the sales and service teams on matters relating to employment law. Review marketing materials and employee communications. Respond to miscellaneous business and employment matters referred to Department. Other projects and responsibilities may be added at the manager’s discretion.
Qualification and Experience
REQUIREMENTS: JD Degree from an accredited law school. Member in good standing with the State Bar. 5-7 years Labor and Employment Law / Litigation / Corporate Law experience. Experience in advising management in legal matters. Outstanding written & verbal communication skills, ‘hands-on’ style and willingness to proactively engage with peers. Ability to excel in an entrepreneurial growth organization. Demonstrated self-initiative, integrity, and resilience. Ability to manage large-scale projects and high-volume, small scale projects.
