House Counsel Attorney Duties: Directly handles assigned litigation from inception through trial and ensures that all internal requirements with respect to reporting are met, while maintaining the highest level of legal representation for National General Insurance and/or its insureds. For all duties and responsibilities, incumbent will take ownership of any issue, problem or error that could impact the company, policyholder and/or loss participant. Maintains reporting procedures, (i.e. file reviews, diary control). Maintains current knowledge of changes in New York law. Ensures that the following tasks are completed: Answer summonses and complaints. Initiate and respond to written discovery. Prepare and respond to motions before the court. Prepare for and attend all court appearances as necessary. Prepare for [including written submissions] and attend arbitrations where appropriate. Prepare for, schedule and conduct depositions and examinations under oath as necessary. Prepare for and attend trials as necessary. Researches and analyzes legal questions and issues. Writes confidential legal memoranda. Drafts confidential opinions. Research and prepare post-trial motions and appeals.
Qualification and Experience
Qualifications: Graduation from an accredited law school and admission to the New York State Bar with 5 - 7 years of experience in defense of homeowners/premises liability claims, automobile liability claims and uninsured/underinsured claims on behalf of an insurance carrier. Experience must include all phases of litigation up to and including trials to verdict involving complex, high risk and/or high exposure cases. Knowledge of the laws and rules governing civil practice in the State of New York. Knowledge of trial and hearing procedures. Ability to write clear and concise prose. Ability to organize factual and legal data into clear and logical statements. Ability to analyze legal issues and identify relevant case opinions and facts. Ability to interpret laws, rules and regulations. Ability to communicate orally in a clear succinct manner. Ability to handle sensitive matters on a confidential basis. Desired: Requires a high degree of initiative, mature judgment, and discretion. Ability to resolve conflicts and empathize with insured’s is critical. Negotiation skills are critical for resolving litigation. Demonstrates professional oral and written communication skills. Organization and time management skills are critical for this position. Demonstrates a solid understanding of insurance law. Demonstrates the ability to find answers to more complex issues with insurance law. Demonstrates a solid understanding of the insurance industry and organizational relationships of the company. Demonstrates a solid understanding of the functions of other departments, such as Claims.
