Patent Counsel, Intellectual Property Candidate will be responsible for strategic management of assigned IP portfolios for specific company programs, including patent prosecution, patent maintenance and associated IP diligence. Effective and efficient supervision of outside counsel. Assist departmental management with: formation and implementation of IP-related company policies, procedures and guidelines (publication review, trade secret policy), and representation on committees (patent review committee); review of agreements affecting assigned IP portfolio, including licensing, collaboration and other associated agreements; IP analyses/diligence related to licensing/M&A, patentability, freedom to operate, infringement issues; and providing IP/legal support (status reports, due diligence ) for other groups within the company like Business Development, Research, Regulatory, Commercial Planning. Will report to the Director, Intellectual Property.
Qualification and Experience
Candidate should have Ph.D. (Biological Sciences like Molecular Biology, Biochemistry). Registration as a Patent Attorney with the United States Patent and Trademark Office and member of the California State Bar is needed. Must have 5+ (and preferably 8) years of biopharma-related patent prosecution and complex IP diligence experience. Must have 1+ years of relevant experience in a law firm. Industry experience as a biological scientist is desired. Experience with USPTO post-grant proceedings and foreign oppositions is preferred. Project and/or personnel management experience is a plus. Familiarity/experience with (i) gene therapy-related technologies, and/or (ii) small molecule patent prosecution/diligence is preferred.
