Legal Specialist IV The candidate in support of the US Pharmaceutical business health systems segment. Will support strategic group purchasing organization (GPO) relationships, as well as a variety of products sold to hospitals and health systems across the country, at the direction of the Lead Counsel for this customer segment. Assume a primary client facing role in the coordination of legal matters pertaining to multiple business units. Responsibilities will include the following: Understanding and identifying legal and regulatory issues in healthcare and pharmaceutical contracts, including determining the level of risk and making appropriate recommendations for resolution; Drafting, reviewing, revising and negotiating healthcare related service and technology contracts, including a range of consulting service offerings, patient assistance program (PAP) administrative services, prime vendor/supplier contracts, web-based software licensing, technology subscription, and business associate agreements (BAA); Contract analysis and interpretation of pharmaceutical distribution services agreements, prime vendor agreements, letters of participation, member agreements, purchase orders, and other terms and conditions (T&C); Analyzing and communicating contract terms to internal business partners; Educating and making appropriate recommendations to clients in order to resolve complex legal and business process issues; Compiling data and information into clear and concise presentation material; Managing customer expectations and prioritization of simultaneous projects in an efficient and timely manner within a fast paced, dynamic environment; and Working with limited degree of attorney oversight, exercising independent judgment in escalating issues within broadly defined practices and policies, and serving as the key resource on behalf of the legal department for internal business clients.

Qualification and Experience

The candidate should have AA and/or paralegal degree plus 9+ years paralegal or legal experience; 4+ year degree is preferred with 7 years experience or JD degree with 4+ years experience. Should have 7+ years experience in healthcare industry or healthcare related contracting. Should have experience with RFPs. Must have strong knowledge of healthcare laws and regulations, such as Federal Anti-Kickback Statute, HIPAA, False Claims Act, FOIA and the Sunshine Act. Must be proficient in Microsoft Word, Excel, Adobe, SharePoint, SalesForce, WorkShare or equivalent programs. Must have ability to effectively explain contracting principles to internal clients and external Customers. Should proficiently capture negotiated provisions in contracts with minimal attorney oversight. Knowledge of pharmaceutical regulations, including Anti-Kickback, HIPAA, FOIA and the Sunshine Act is needed. Must have strong written and verbal communication skills. 340B Prime Vendor, Corporate and GPO contract compliance are required. Must have familiarity with web-based software licensing, B2B technology contracts and government contracting. Should have ability to understand the broader context of issues that arise during contract negotiations. Must have ability to work effectively with clients and promote the reputation and integrity of the Law Department and company.
