Chief Counsel Water Duties: Provide legal support during pursuit and negotiation of higher risk projects such as design-build, construction management at risk, design to a design-build team, program management and construction management opportunities. Provide legal support to higher risk projects during delivery, and provide risk management through on-going legal engagement and training, and provide legal support for the management of changes and claims. Provide legal advice on complex public sector procurement issues and bid protests. Work in collaboration with the Chief Counsel Litigation on providing legal support for potential claims and disputes. Provide legal advice to the Water Business Group President and his/her executive team as a trusted advisor. Monitor legal and contracting trends in the AEC industry and in water markets. Develop proactive protocol to routinely identify and manage project risk within the Water Business Group and advise company management of the same. Coordinate the efforts of outside attorneys on a case-by-case basis as required. Assist in the development and implementation of policies and processes to improve efficiency and risk management. Assist with the professional growth and development of the legal team through formal and informal mentoring. Will have responsibility for development and implementation of legal department initiatives including training programs for operational staff.
Qualification and Experience
Qualifications: JD Degree. Must be a member in good standing of a state Bar. Preferred locations for this position are Omaha, NE, Northern California, Washington DC area, Houston, Denver and New York area. Must have a track record of being proactive and focused on continuous improvement. 12+ years progressive experience as senior in-house counsel with a engineering/architecture/design-build or construction firm. Some amount of law firm experience preferred. Previous management and mentoring experience not required but strongly preferred. Experience with operations and management contracts for water and wastewater plants is preferred. Experience with complex agreements for construction and design-build projects required. Drafting and negotiating experience for design-build, progressive design-build, construction management CM at risk, program management, alliance or integrated project delivery and architectural engineering and consulting agreements. Experience with change order management, disputes, litigation, arbitration, and mediation required. Prior experience in engineering or construction required. Prior experience on global projects and contracts preferred. Excellent previously demonstrated negotiating skills. Ability to identify and manage risk inherent to projects in the engineering/architecture consulting industry. Proactive and able to drive change. Ability to think on their feet. Strong proponent of working as a team within legal and within the business. Ability to interact with clients, contractors and colleagues in a collaborative, pragmatic and productive fashion. Demonstrated track record of exceptional business judgment, pragmatism and sophistication on commercial aspects of the AEC industry and contracts is required. Strong people skills and ability to lead through persuasion.
