School Attorney Duties: Will render services as directed by the General Counsel. Attend Board meetings and other administrative meetings to provide legal counsel. Advise the Superintendent of Schools and Board of Trustees on legal matters relating to the operations of the district (i.e. administrative procedures, public employment, contracts, bids, construction, real property, student rights, general public education law, special education law) for the purpose of ensuring all activities are conducted according to all laws and regulations. Accept services of process of citations served on the district and Board of Trustees as directed by the General Counsel. Accept and respond to notices of claims and demands against the district. Prepare documents and pleadings, as needed, in regard to misdemeanor cases served on the district or its employees. Assist with coordinating and overseeing timely compliance with subpoenas, including subpoenas for student records, employee records or other types or records. Assist outside counsel with the evaluation of findings and in the development of strategies and arguments in preparation for cases for the purpose of helping outside counsel in defending lawsuits filed against the district. Coordinate work performed by outside counsel (i.e. gather evidence, interpret policies and procedures, interview staff, etc.) for the purpose of ensuring outside counsel has the information and material available to advise and defend the district. Prepare reports, memorandum and other written documentation for the purpose of documenting activities, providing written reference and/or conveying information. Provide advice to the appropriate district representatives regarding all matters of student discipline involving suspensions and student appeals for the purpose of ensuring all laws, regulations and policies are adhered to. Handle complaints, hearings and litigation related to Special Education (or delegating the same to staff or outside counsel). Provide legal assistance and support to principals and other designated district staff in the course and scope of their district employment, for the purpose of ensuring they are informed of all laws, rules and regulations that are pertinent to their job responsibilities. Coordinate and provide in-service training on legal matters for the purpose of keeping administrators informed of the latest changes in the laws and to prevent errors in the application of the law. Provide legal representation for the district in responses to investigations conducted by the Office of Civil Rights, Equal Employment Opportunity Commission, Texas Commission on Human Rights and other administrative and regulatory agencies. Provide legal representation for the district in hearings before independent hearing examiners, including the Texas Education Agency, State Board of Educator Certification, or other boards or agencies. Draft, review and provide legal advice on legal documents, rules and regulations, resolutions, contracts and agreements, and all other legal or quasi-legal documents upon request. Provide legal assistance, as requested, in drafting, monitoring and interpreting the impact of proposed or enacted state and federal legislation in the interest of the district. Conduct periodic reviews of board policies, internal procedures, and state and federal law to ensure district compliance. Assist in the writing, review and revision of board and district policies and regulations Assist in negotiating and drafting contracts for professional services, the acquisition of real and personal property, the employment of architects, contract management firms, contractors and other entities. Provide assistance and advice regarding district records, including requests made under the Texas Public Information Act. Monitor compliance with the Texas Open Meetings Act. Provide legal counsel on the use of district facilities. Oversee the legal aspects of district elections. Receive and respond to telephone inquiries related to legal issues from district staff. Research public and other legal records, as needed, for the purpose of writing legal opinions or answering legal questions posed by other departments. Attend continuing legal education seminars regularly to acquire and maintain knowledge of pertinent areas of the law. Perform duties in a professional manner through daily, punctual attendance at the location of the work assignment. Perform duties in a professional, ethical and responsive manner as defined by the Texas Disciplinary Rules of Professional conduct. Perform other related duties as necessary, as requested, or as assigned by the General Counsel.

Qualification and Experience

Qualifications : Doctor of Jurisprudence degree from an accredited law school; licensed by the State Board of Law Examiners of Texas as an Attorney and Counselor at Law. 3+ years of public or private practice dealing with legal issues of local, state, and federal government, or public school law; strong preference for candidates with real estate, construction, bond and/or contract negotiation experience. Knowledge of federal, state, and local laws and regulations relating to public education law, employment law, contract law, and related issues affecting a school organization. Should have skill in conveying clear and concise oral and written communication. Ability to anticipate, manage, analyze, evaluate, and summarize legal issues and findings, and to present legal issues, findings, and recommendations in a clear and concise manner to district personnel and other individuals or at proceedings. Ability to prepare and represent the district in administrative hearings. Excellent Legal research litigation skills and analytical skills required to achieve the goals of the position. Should have skill to represent the district in negotiations with vendors, contractors and other entities. Ability to analyze complex legal issues; manage multiple projects/programs; problem solve; and use of technology. Ability to analyze and solve legal problems and interpret laws, policies, and procedures affecting the district. Ability to work independently and as a team member. Excellent interpersonal skills, including the ability to understand human motivation and the ability to apply such knowledge to maintain good working relationships with district representatives, co-workers, subordinates and others.
