Claims Attorney Duties: Responsible for the direct handling of serious property Damage (PD) and Bodily Injury (BI) claims and coverage and/or liability issue claims throughout the U.S. involving state specific laws and regulations. Direct outside counsel and establish litigation plans in order to reach cost effective resolutions of PD and BI claims, including those involving high risk and high exposure. Investigate new claims, make liability decisions, apply comparative negligence where applicable and negotiate settlements. Understand and apply state specific law and regulations in highly litigious venues across the country. Recognize coverage issues and work with your supervisor to resolve. Establish case reserves within our company guidelines. Refer law suits to properly approved defense attorneys and direct their handling, including the authorization of discovery actions and motions practice. Expense control of fees from independent adjusters, defense attorneys and other vendors. Recognize the various state laws, regulations and claim handling compliance. Document claim file notes clearly summarizing all correspondence and activities using factual and objective data. Act as a mentor to fellow team members and assist the claims supervisor in training new hires, enabling them to learn the claims system and departmental procedures. Respond to time sensitive material such as phone messages, settlement demands, intercompany arbitration hearings and insurance department complaints. Maintain a current 30-day diary on all open claims. Attend mediations and trials as mandated. Perform other duties or ad hoc tasks as assigned.
Qualification and Experience
Qualifications: Bachelor’s degree from a four year college or university preferred. A Law Degree is highly preferred, and a background in insurance defense is a plus. 3-5 years’ experience handling complex coverage investigations and high exposure physical damage and auto liability claims, including litigated files, or equivalent experience. Commercial auto, general liability and multi-state experience are helpful and claims designation and/or state licensing are a plus. Ability to read and interpret legal documents, insurance policies and medical reports and billings. Strong written, verbal and interpersonal communication. Working knowledge of Microsoft Word, Excel, Power Point and Outlook. Solid analytical, reasoning and problem solving abilities. Flexibility regarding working hours in order to meet deadlines.
