Discrimination Case Manager Duties: Maintain legal and policy compliance for the Department’s obligation for timely, effective response to internal and externally-filed complaints of workplace discrimination, reprisal and discriminatory harassment. Responsible for ensuring compliance with current case law, guidance and statutory provisions in a number of state and federal laws, including Title VII of the Civil Rights Act, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Minnesota Human Rights Act, State Personnel Management, Minn. Stat. Chapter 43A, the Minnesota Government Data Practices Act, Minn. Stat. Chapter 13, FHWA Civil Rights laws, relevant rules of Civil Procedure, and all related internal policies. Primary point person who confers regularly with the Minnesota State Attorney General’s Office and MMB on internally and externally filed complaints of discrimination and lawsuits claiming discrimination that are filed in state and federal court. Confers with the Office of General Counsel on legal issues associated with case processing, case litigation and data practices. manages all aspects of the Agency’s statewide internal complaint process, including making the decision to formally investigate or recommending informal processes, e.g. mediation; case referral; determining investigative strategies/processes; hiring and directing contractors to perform expert discrimination investigations; drafting comprehensive investigative reports; and making findings and recommendations for appropriate follow-up.
Qualification and Experience
Requirements: A JD Degree and 2 years advanced professional experience applying state and federal non-discrimination law in the public sector; Current licensure by the Minnesota State Bar Association. Extensive experience and expertise in the areas of public sector employment law and policy, including non-discrimination, affirmative action, labor law and data practices law. Experience performing legal/case analysis that is legally or procedurally complex; Experience performing all aspects of complaint investigations including drafting comprehensive investigative reports and findings and providing follow up guidance and direction to management; Experience responding to discrimination complaints in a timely and effective manner; Experience making recommendations to others, sufficient to advise the AAO Director and agency management on managing and limiting risks; Oral and written communication skills sufficient to train and/or guide personnel at all levels on non-discrimination and affirmative action law and policy; Experience managing confidential or privileged information discreetly and in compliance with the Minnesota Government Data Practices Act (MGDPA); and Knowledge of contract law sufficient to write and/or manage state contracts.
