Assistant General Counsel, Collections and Bankruptcy (Secured and Unsecured Products) The candidate will counsel executive and mid-management level business clients on the legal, business, and operational issues associated with the Fair Debt Collection Practices Act, state debt collection laws, United States Bankruptcy Code and local rules, FHA/HUD, Truth-in-Lending, Fair Credit Reporting Act, Gramm-Leach Bliley, Telephone Consumer Protection Act, Equal Credit Opportunity Act and other applicable federal and state laws governing the servicing and collection of consumer debts. Will provide day-to-day legal support in the development of policies and procedures, customer-facing documents, outbound/inbound telephone scripting, vendor contracts and training materials. Provide legal support for escalated issues which may include threatened litigation and executive or regulatory complaints. Track bankruptcy and default related legislation and case law and convey relevant developments of such to business clients. Provide the collection/default management groups with prompt and well-reasoned legal support that positions the business in a competitive and legally sound environment.
Qualification and Experience
The candidate should have a law degree and 5+ years of experience directly supporting Bankruptcy and other default or collections departments, preferably in the banking or financial services industry or in a law firm representing creditors. Should be a senior attorney with strong leadership and management skills; an in-depth understanding of current issues impacting financial services; an ability to focus on the big picture (even when addressing legal, compliance and quality issues) and helping to assess and manage risks; an ability to think creatively and abstractly to find new ways to accomplish goals; strong organizational skills; the ability to effectively manage a significant workload; a practical approach to providing legal advice, utilizing sound judgment and logical reasoning.
