Bankruptcy Attorney Duties: Will be principally responsible for providing legal services to the company with particular emphasis on providing advice and counseling to mortgage servicing default operations. Active involvement in counseling the bankruptcy team on legal issues and practices; assisting with the monitoring of default counsel and trustee services in both judicial and non-judicial states; drafting and reviewing consumer communications; conducting file reviews; monitoring changes in laws and regulations and communicating such changes to mortgage default management and personnel; reviewing policies and procedures and providing training to servicing associates; interfacing with bankruptcy counsel on individual loan file issues, serving as the central point of contact for requests for legal services related to bankruptcy matters and coordinating with other members of the Legal Staff on the provision of legal services to servicing operations. Manage a case load of litigation matters where bankruptcy issues predominate. Review and revise statements of work and attorney quality expectation documents for bankruptcy counsel. Assist with due diligence risk assessment and quality reviews of new firms and conduct on-site visits of existing default/ bankruptcy counsel; review the firms’ policies and procedures and practices for compliance with Federal, state and local laws; audit bankruptcy files for compliance with applicable laws. Develop quality metrics for measuring and monitoring performance of bankruptcy counsel; participate in quarterly reviews with default counsel and third party vendors; interact with bankruptcy counsel to coordinate legal services as requested by mortgage default operations; advise servicing operations of new laws and regulations relating to residential mortgage bankruptcy matters and related practices; keep management apprised of new issues and trends participate in the review of servicing operations policies and procedures; provide training to servicing personnel on bankruptcy practices. Provide advice and counseling in connection with risk assessments, compliance testing, internal audits and state and federal examinations of mortgage default operations; drafting and reviewing disclosures, documents and communications related to bankruptcy matters; monitor bankruptcy matters managed by default counsel; assist with preparation of employee depositions and corporate witnesses in connections with bankruptcy hearings; review employee deposition transcripts; review and draft responses regarding complaints received alleging defective bankruptcy practices; build and maintain working relationships with servicing operations management, compliance, internal audit and risk functional partners; and manage a portfolio of litigation matters involving bankruptcy claims.

Qualification and Experience

Qualification Requirements: A Juris Doctorate degree. Membership in good standing in Minnesota or Pennsylvania Bar or ability to become licensed to practice law in either Minnesota or Pennsylvania. 10+ years of experience in consumer bankruptcy issues practicing in a law firm, US Trustee office or in-house setting. Familiarity with mortgage foreclosure issues and litigation experience is a plus. Excellent interpersonal and communication skills.
