Associate General Counsel- Privacy Attorney The candidate will provide legal advice to the Insurance Group and other business units regarding state and federal privacy law and regulation, information security, anti-money laundering and compliance with OFAC sanctions programs. Perform legal research and write legal memoranda. Gather facts from multiple sources; interact with client areas, keeping them advised of developments and status of all matters. Advise on security incident response policies, assessments, and responses. Advise on data privacy and security compliance requirements. Advice on data privacy and security issues related to third-party transactions and arrangements, including arrangements with vendors. Draft and negotiate non-disclosure agreements and contractual provisions with customers and vendors regarding data privacy and security protections. Maintain a network of privacy representatives and contacts. Lead and participate on Privacy projects as they arise. Provide consultation services to other practice groups of OGC as necessary. Advise on the Company's information and physical security policies and practices. Respond to third-party and regulatory questionnaires and inquiries regarding privacy and security compliance matters. Monitor local and global legal developments in data privacy and security.
Qualification and Experience
The candidate should have J.D. degree with 8 years of relevant experience in law firm and/or corporate law department. Admitted to the New York Bar membership is required. Experience reviewing and commenting upon proposed federal and state legislation and interfacing with lobbyists and lawmakers is needed. Experience working with regulated financial institutions is preferred. Experience working with regulated financial institutions is desired. Must have strong oral communication, writing and client facing skills are required. Should have in-depth knowledge of US privacy and security laws, regulations, standards and best practices, including GLB, HIPAA, and PCI, FCRA and state laws, including state breach notification laws. Deep knowledge of related areas including TCPA, CAN SPAM, OFAC sanctions and anti-money laundering is needed. Thorough understanding of emerging privacy and data protection laws, cases and trends as well as new and evolving technologies is required. Understanding of existing and emerging technologies and platforms including: big data analytics; mobile apps; web and devices; social media; and cloud computing and hosting is needed. Should have strong writing, analytical, and communication skills. Attention to detail and outstanding organizational skills are required. Must have ability to communicative effectively with security and risk professionals, software developers, product development, R&D, Human Resources, and other teams.
