Director, Assistant General Counsel - Privacy The candidate will provide enterprise-wide support to its businesses on privacy and related matters. Will provide advice and assistance on the many federal and state privacy and data security regulations that impact company's businesses, including GLBA, HIPAA, CAN-SPAM, TCPA, TSR as well as data security and breach notification requirements. Provide support in directly to Corporate Compliance, Information Security functions and associates in all company's lines of business. Assist with management with relevant examinations and other supervisory requests is also required. Interpret and advise on privacy matters, the Assistant General Counsel - Privacy may also be required to provide legal support on other regulatory and/or state law matters - including, for example, unclaimed property and payments. Report to the Senior Associate General Counsel, Regulatory Advisory. Provide expert interpretations and advice on all applicable federal and state privacy and data security laws including, GLBA, HIPAA, CAN-SPAM, TCPA, TSR, federal and state data security and breach notification rules and regulations. Advise and influence executives and other associates regarding the impact of US federal and state privacy and data security statutes and regulations in various areas across company. Analyze and interpret complex proposed laws and regulations impacting business units and assist in devising compliance methods that meet business goals and objectives. Review and analyze new products and services for privacy and data security issues, including online and mobile applications, and influence the design process using privacy by design principles. Assist in the review of marketing and servicing communications. Manage outside counsel regarding US privacy and data security matters. Advise company's Corporate and Strategic Transactions legal team and Enterprise Supplier Management functions on privacy and data security issues arising in third party agreements.
Qualification and Experience
The candidate should have a J.D. degree with admission to at least one State Bar. Must have 7+ years of experience in a law firm, in-house legal department and/or federal regulatory agency. Should preferably have 5 years of experience focused on consumer financial services generally with experience in privacy related matters and issues with 3 recent years of experience focused on privacy. Should also have experience advising financial institutions on privacy matters, and a working understanding of other related laws and regulations. Must have provided significant support to clients in the financial services industry and/or retail banking, including development and review of all aspects of consumer loan programs. Experience with online and mobile privacy issues, and self-regulatory regimes governing for online advertising is required. Knowledge of PIPEDA (Canada) and European privacy laws/standards is needed.
