Attorney Adviser (General), GS-0905-13 DUTIES: Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of interpretation and litigation of U.S. and state/territories constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters. Serves the state/territory National Guard as a litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory and Federal courts of original or appellate jurisdictions. Conducts investigations of fact and legal sufficiency; advising on administrative remedies; develops the trial strategy, content and means of presentation, and trial delivery; makes motions; and conducts post-trial duties. Serves as the attorney/adviser providing acquisition and fiscal legal advice to the state/territory’s assigned United States Property & Fiscal Officer and active duty military advisors. Advises Army National Guard and Air National Guard contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds for legal sufficiency, appropriate titling and claim initiation or resolution actions. Acts as the Adjutant General’s representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Represents the state/territory National Guard as a trial attorney on assigned cases before investigators, administrative judges and arbitrators from various appellate bodies including, but limited to, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the Federal Services Impasses Panel and Federal Courts. Advises convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions. Serves as the state/territory Federal Ethics Adviser. Provides or participates in various training activities, prepares reports and provides counsel on complex ethics issues and policies; and ensures Federal and state/territory annual administrative reporting requirements are met. Serves the claims officer for the state/territory National Guard. Reviews Claims investigating officer reports, adjudication recommendations, regardless of filing location, and approves forwarding of actions to the appropriate claims office. Provides legal assistance as needed for members of the National Guard of the State by providing the following: Domestic relations. Advises on legal and practical meaning and effects of divorce, legal separations, annulment, custody. Wills and estates. Provides legal advice and counseling on wills and estates. Drafts and executes wills and codicils. Advises on estate planning to include minor tax considerations and non-trusts under applicable state statues, or refers to private attorneys. Nonsupport and indebtedness. Advises and counsels on effect and procedures, to include garnishment rules, repossession procedures, default judgments, adverse personnel actions. Landlord-Tenant relations and customer affairs. Advises and counsels on tenant's rights; eviction procedures; the legal effect and meaning of leases, offers to purchase, sales contracts and customer's rights in dealing with merchants and lenders; credit reporting agencies; etc. General. Prepares complex powers of attorney and other instruments, advises on immigration/naturalization procedures, insurance matters, general contracts, personal property law. Provides oversight and guidance to the state/territory Judge Advocate’s Legal Office, legal assistance and preventive law programs, and helps to supervise the full-time State attorney and paralegal support staff. Also coordinates the provision of legal services throughout the State and oversees assignment of traditional M-Day attorney and paralegal personnel within the subordinate units in the both the Army and Air National Guard to accomplish all legal support requirements.

Qualification and Experience

QUALIFICATIONS:

EDUCATION REQUIREMENT: GS-13 level: A Law Degree (LLB / J.D) from a law school accredited by the American Bar Association.

AND

Bar Membership: Be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar.

SPECIALIZED EXPERIENCE: Must have 3 years experience, education or training in the preparation of cases for trial and/or tries cases before a court or an administrative body of persons having quasi-judicial power, the rendering of legal advice and services with respect to questions, regulations, practices or other matters falling within the purview of a Federal Government, the preparation of interpretive and administrative orders, rules, or regulations to give effect to provisions of governing statutes or other law requirements. Skill in analyzing, discussing and providing oral and written counsel on complex legal arguments in a representative capacity in a manner that aids the recipient in understanding the issues, options, and recommended courses of action.

To be creditable, experience must be: Progressively responsible; formulating legal policies; monitoring, coordinating and directing legal activities; preparing and rendering legal advice, opinions and decisions; acting as trial counsel on general or special courts-martial and other military tribunals; sit as an appellate judge for the review of such cases; prepare and present brief and oral arguments on behalf of the U.S., the National Guard, and/or the TAG.
