Attorney-Adviser (General), GS-0905-12/12 Duties: Serves as the sole full-time professional legal advisor, providing consultation, collaboration, support, guidance, and subject matter expertise (SME) to the Wing Commander. Also serves as the full-time legal advisor to Geographically Separated Unit (GSU) commanders and staff. Provides SME authoritative advisory, consultation, and collaboration in the areas of ethics, medical and physical evaluation, labor, domestic operations and administrative law. Advises Commander and staff on interpretation of federal statutes and regulations, ensures that legal advice, consultation, and collaboration is furnished in a timely manner. Advises senior leadership of the alternatives and possible solutions which are legally permissible or desirable. Prepares, researches, and issues oral and written legal opinions and legal advice with regard to a wide variety of laws, regulations, instructions, directives and policies in the area of Administrative Law. Provides advisory, guidance, consultation, and collaboration to Commander, staff, and supervisors. Coordinates with State Human Resources Office and the State Judge Advocate on all labor law training as well as impact on established programs, procedures, and methods of operation. Provides preventive law guidance to management personnel on the impact of regulatory changes. Provides advice, assistance, administration and command reporting for filing with the Office of Government Ethics. Provides legal assistance on a non-interference basis to members of the ANG, spouses of members, and family members as authorized by ANGI 51-504, AFI 51-504 (when applicable), CNGBI, NGR, and other AF/JA guidance and, as resources and expertise permit, legal assistance may also be provided to Active Component members, other Reserve Component members, and retirees of any military service. Formulates Wing legal policy and its execution; legal representation; legal initiatives; constitutional, civil, criminal, labor law; a full spectrum of expert legal advice to Wing leaders. Prepares and renders legal advice and opinions to commanders and senior staff regarding military justice options. Prepares and renders legal advice on disciplinary matters, nonjudicial punishment, and statutory pretrial advice in prospective court-martial cases. Prepares statutory post-trial advice and actions of convening authority. Provides legal advice, legal briefings, and counsel to Wing leadership on the DES process. Provides professional legal advice and opinions on issues arising from federal laws and regulations and their application to the National Guard or concerning the federal mission of the National Guard, including homeland defense and security, emergency response, and application of state/territory compacts.

Qualification and Experience

Qualifications:
Must be a current military member of the Utah Air or Army National Guard to be considered for this vacancy.

Must have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia

Must have 12+ months of working experiences as a professional Attorney Advisor. Must be experienced in the Air National Guard programs and organizational mission requirements. Experienced in conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts. Experienced in addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments. Experienced in addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations. Experienced in researching and providing legal advice in functional areas of Administrative, Labor, Medical and Physical Disability and Ethics Law. Experienced in planning, coordinating, and formulating litigation strategies. Experienced in addressing complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents. Experienced in dealing with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues. Experienced in developing and providing solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state legal guidance. Experienced in addressing and resolving complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution. Experienced in preparing memoranda of reports that outlined and analyzed the factual and legal issues. Experiences involved preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency. Experienced in addressing Federal Labor-Management relations and skilled as a participating collective bargaining member of the management negotiating team. Experienced in reviewing programs that required analysis of interrelated issues of effectiveness, efficiency, or productivity; and, developed recommendations to resolve issues and problems. Experienced in addressing issues, problems or concepts and skilled in observations and analysis projections. Experiences included addressing difficult and sensitive issues based on variations in the nature of the processes evaluated, the diverse missions of the units assigned, and resource limitations. Experienced in compiling, reconciling, and correlating data from a various sources, separate service programs, and integral record systems. Experienced in researching, cross-checking information, and interpreting data to obtain accurate and relevant information. Experienced and skilled in collecting information, documenting data to substantiate and validate findings, facts, or violations of government policies, procedures, and instructions.

Must be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar.
