Money Makes the World Go 'Round'

The talk of the legal blogs this week is about Judicial Hellholes. Don't laugh, you may just live in one! What are they? They're America's most unfair jurisdictions in which to be sued—unfair if you're the defendant that is. Where are they? West Virginia topped the list as a ''hotbed of anti-business rulings, massive lawsuits and cozy relationships between the personal injury bar, the state attorney general and some in the judiciary'' says the American Tort Reform Association. South Florida and Chicago secured the #2 and #3 spots respectively.

Legal Blog Round-Up: 12.2.2008 Edition

Can you believe it's already December? It's amazing how fast time flies by, especially during the holiday season. Just like you and me, law firms are busy around this time of year, too. Typically it's a lot of holiday party gossip (not so much this year) and bonus speculation (again, less than normal this year), but this year is different. Instead of champagne and bonus checks, it's layoff speculation and the like.

Legal Blog Round-Up 11.21.08

As usual, there were interesting reports and commentary in legal blogs this week. Above the Law discussed a highly disturbing case of sexual abuse at a home for the mentally ill. While most of us regard psychotherapy with some degree of skepticism and cynicism, what Arlan and Linda Kaufman face trial for is something altogether bizarre and sad.

Legal Blog Round-Up 11.14.08 Edition

This week, Above the Law was on their usual hunt for, what they call, 'Stealth Layoffs'. ALT named both Shearman & Sterling and Loeb & Loeb so far this week. According to ALT tipsters, Shearman & Sterling is asking mid and senior level attorneys to leave, when in normal conditions those attorneys would have left on their own accord already. The firm reportedly wants the legal world to believe they are performance based firings, when insiders say that is simply not the case.

Bryan Cave and Powell Goldstein officially announced their merger. Atlanta-based PoGo is set to join St. Louis-based Bryan Cave. PoGo had recently had troubles and a merger was their best option. Glad to see it's working out.

In the past week, of course, the dominant story has been the financial crisis. Many people have opposed the planned bailout, a deal for which has so far not been reached. Meanwhile, several large names in the financial and legal worlds have suddenly disappeared. Washington Mutual got bought by JP Morgan, and Heller Ehrman dissolved. Analysis of Heller's untimely death is pouring in.

Luckily for this week's edition of ''Inside Legal Blogs,'' there were quite a few interesting discussions this week in the legal ''Blawgosphere.'' There were, for example, some philosophical ones, such as the discussion that raged on Volokh and PrawfsBlawg about ''theophobia,'' or the hostility of academics towards religion. In fact, religion was in the news a lot this week, as was gay marriage, what with wedding bells beginning to ring in California for same-sex marriages.

Legal blogs have changed many things. Indeed, they are growing more and more important in the legal industry and are beginning to have far-reaching impacts. As a case in point, the Patent Troll Tracker blog, which was an anonymous blog that focused on patent litigation, frequently derided those patent attorneys who represented companies that sued for patent infringement as their sole existence. Turns out the blog was being written by a patent attorney at Cisco systems, and thus it has been quite controversial with regard to conflict of interest grounds.

Is sex in public the same thing as free speech? I'm not so sure, but the ACLU is putting all of its legal might into this latest argument to protect embattled Idaho Senator Larry Craig from losing his post in the U.S. Senate. It may seem odd that one of the nation's most liberal and progressive institutions is working so hard to defend one of the government's arch-conservatives who has ironically (and now famously) opposed the legalization of gay marriage. Well, maybe (just maybe) there's some hope for citizen privacy rights after all. It turns out that our malfunctioning, Constitution-shredding government is more stupid than evil. (I can hear you saying, ''What, this is news?). The FBI, which has been eagerly trampling basic First Amendment freedoms with what is widely considered illegal wiretapping, recently saw its efforts thwarted by none other than the telephone company. Apparently the FBI is having trouble paying its telephone bill, which has interrupted government-sponsored ''investigations'' into conversations between ''suspected criminals.''
