Meanwhile, state officials are scrambling trying to figure out how they can legally detain these 'dangerous' inmates and any future inmates behind bars who have been denied parole for decades due to the severity of their crimes.

By Silas Reed

Many people know that a judge goes through a lot of training in school and as an attorney in order to achieve that position, but not many know what a judge actually does. It may seem to a lot of people that the day in the life of a judge would not be hard at all. Know some laws and listen to the good guys and the bad guys and make a decision based on that. There is a lot more to being a judge then just that though. It is important to know that a person who intends on becoming a judge has a lot of training that they have to go through. They also have to spend a lot of years as an attorney before they can even consider running for judgeship. But what does a judge do all day?

Becoming a Supreme Court Justice
By Silas Reed

If you aspire to be a Supreme Court Justice for the United States, you have high aspirations indeed. To be a Supreme Court Justice would make you one of the most powerful, and one of the most responsibility-charged, people in the nation. Your responsibility, of course, would be to interpret the laws of the U.S. Constitution and to apply those interpretations to cases that are brought for appeal before the Court. Supreme Court decisions about a case are final. They cannot be overturned or appealed to any other court, and all state courts must make their rulings based upon the Court's from that time forward. The only possibility of having a Supreme Court decision overturned is to have another case accepted by the Court in the future in which the future Justices decide the case in a way that overturns the previous decision. Some people want this done with the 1973 Roe v. Wade decision concerning federal laws protecting abortion rights, for instance. But the Supreme Court decides which cases it will hear, and until a new abortion rights case comes up in a state court that the highest court in the nation thinks is important enough to hear, there won't be any overturning of the 1973 decision.

Death Penalty Sentence Requires Qualified Lawyers

The death penalty is becoming more prevalent today. For many years states had abolished this practice. However, in the last few years the need has apparently risen in several states to bring it back. There have been many instances of defendants who were wrongly accused and found guilty of crimes they did not commit being given the death sentence. This was especially true before modern technology gave us DNA and other means of proving or disproving one person was responsible for a crime of this nature. This necessitates more than ever the need for the legal job of criminal lawyers.

Legal Blog Round-Up 11.21.08
By Liz Jernigan

As usual, there were interesting reports and commentary in legal blogs this week. Above the Law discussed a highly disturbing case of sexual abuse at a home for the mentally ill. While most of us regard psychotherapy with some degree of skepticism and cynicism, what Arlan and Linda Kaufman face trial for is something altogether bizarre and sad.

Poll: Obama Supporters Don't Want Constitution Used in Supreme Court Cases
By Stony Olsen

This is a rather shocking result. It's rare that the Supreme Court is a question of polling, but with recent political rhetoric along the lines of ''Bush has destroyed the Constitution'' and ''we are all living in a fascist state,'' it occurred to polling company Rasmussen to poll Americans on their current attitudes about the Supreme Court — and break the results down politically.

Medellin Finally Executed By Texas
By Stony Olsen

Defying the World Court, Mexico, the Bush Administration, and others, Texas went ahead and executed Jose E. Medellin via lethal injection on Tuesday, August 5th, 2008. He and five fellow gang members attacked the Houston, Texas, girls as they were walking home on a June night, raped and tortured them for an hour, then kicked and stomped them before using a belt and shoelaces to strangle them. Their remains were found after four days, and after Medellin had started bragging about the killings to friends.
